I, PÁDRAIG FAULKNER. Minister for Posts and Telegraphs (in exercise of the powers conferred on me by section 2 of the Telegraph Act, 1885, and with the consent of the Minister for Finance, hereby make the regulations contained in the following Warrant:— 1. (1) This Warrant may be cited as the Telegraph (Inland Written Telegram) Amendment (No. 17) Warrant, 1979. | |||||||||||||||||||||||||||||||||||||||||||||||
(2) This Warrant shall come into operation on the 1st day of October, 1979. 2. In this Warrant— | |||||||||||||||||||||||||||||||||||||||||||||||
"the 1920 Regulations" means the Telegraph (Inland Written Telegram) Regulations, 1920; | |||||||||||||||||||||||||||||||||||||||||||||||
"the 1955 Warrant" means the Telegraph (Inland Written Telegram) Amendment (No. 6) Warrant, 1955 ( S.I. No. 44 of 1955 ); | |||||||||||||||||||||||||||||||||||||||||||||||
"the 1975 Warrant" means the Telegraph (Inland Written Telegram) Amendment (No. 15) Warrant, 1975 ( S.I. No. 312 of 1975 ); | |||||||||||||||||||||||||||||||||||||||||||||||
"the 1977 Warrant" means the Telegraph (Inland Written Telegram) Amendment (No. 16) Warrant, 1977 ( S.I. No. 72 of 1977 ). 3. (1) The 1920 Regulations are hereby amended by— | |||||||||||||||||||||||||||||||||||||||||||||||
( a ) the substitution of the following for paragraph (1) of Regulation 7: | |||||||||||||||||||||||||||||||||||||||||||||||
"7.—(1) Subject to the provisions of these Regulations, there shall be charged and paid for the delivery of a Telegram by a special messenger at an address beyond the limits of free delivery the sum of 10p for any distance which is a multiple of sixteen hundred metres and for any distance part of a multiple of sixteen hundred metres from the boundary of the free delivery area"; | |||||||||||||||||||||||||||||||||||||||||||||||
( b ) the substitution of the following for Regulation 20 (inserted by Regulation 3 (1) (b) of the 1977 Warrant): | |||||||||||||||||||||||||||||||||||||||||||||||
"20.—A Telegram may, at the request of the sender, be delivered at several addresses within the limits of the free delivery of the Terminal Telegraph Office, and in such case 10p shall be charged and paid for the delivery of the telegram at each address after the first. | |||||||||||||||||||||||||||||||||||||||||||||||
Accordingly if, for example, a telegram contained a message of ten words of text and the following addresses (which contain twelve words): | |||||||||||||||||||||||||||||||||||||||||||||||

( c ) the substitution of the following Regulation for Regulation 23: | |||||||||||||||||||||||||||||||||||||||||||||||
"23.—(1) The text and the signature for telegrams may be expressed in plain language or in secret language but where secret language is used the sender must produce upon request the code from which the text or the signature of the telegram is compiled. These languages may be used together in the same telegram. | |||||||||||||||||||||||||||||||||||||||||||||||
(2) For the purposes of these Regulations— | |||||||||||||||||||||||||||||||||||||||||||||||
plain language is that which presents an intelligible meaning in a language which is in current use in the State or elsewhere and which is regarded as being plain language by the International Telegraph Service, and for the said purposes telegrams in plain language are those in which the text and the signature are wholly in plain language; | |||||||||||||||||||||||||||||||||||||||||||||||
a telegram which is not in plain language shall be regarded as being in secret language"; | |||||||||||||||||||||||||||||||||||||||||||||||
( d ) the substitution of the following for Regulation 24: | |||||||||||||||||||||||||||||||||||||||||||||||

Roman figures will be transmitted as Arabic figures. If the sender intends the addressee to be made aware that Roman figures are meant, the French word "Romain" shall be inserted in the transmitted text in front of each such figure or group of figures. | |||||||||||||||||||||||||||||||||||||||||||||||
The cross sign (+) used as a sign of addition may be utilised in a group but not as an isolated sign"; | |||||||||||||||||||||||||||||||||||||||||||||||
( e ) the substitution of the following for Regulation 25 (1): | |||||||||||||||||||||||||||||||||||||||||||||||
"25.—(1) Subject to the provision of these Regulations, the contents of telegrams shall be reckoned and telegrams charged for with reference to their contents as follows: | |||||||||||||||||||||||||||||||||||||||||||||||
( a ) (i) in the counting of words a distinction shall be made between the number of actual words and the number of chargeable words, | |||||||||||||||||||||||||||||||||||||||||||||||
(ii) each separate word or group of characters shall be counted as one actual word, | |||||||||||||||||||||||||||||||||||||||||||||||
(iii) words, groups of characters or expressions not exceeding ten characters shall be counted as one chargeable word each and words, groups of characters or expressions exceeding ten characters shall be counted at the rate of one chargeable word for each ten characters or part thereof. | |||||||||||||||||||||||||||||||||||||||||||||||
(iv) service indications (if any) shall be included in the number of chargeable words, and | |||||||||||||||||||||||||||||||||||||||||||||||
(v) the verification of the signature if the sender asks for it to be transmitted shall be included in the number of chargeable words. | |||||||||||||||||||||||||||||||||||||||||||||||

( b ) Everything that the sender intends to have transmitted shall be chargeable with the exception of the route indicator and the name of the code used for the wording of a secret language telegram where this information is required to be given. The following however shall not be included in the number of actual and chargeable words nor shall they be transmitted: | |||||||||||||||||||||||||||||||||||||||||||||||
(i) dashes used only to separate on the sender's copy words or groups of characters, | |||||||||||||||||||||||||||||||||||||||||||||||
(ii) other isolated signs unless the sender has specifically requested their transmission, | |||||||||||||||||||||||||||||||||||||||||||||||
(iii) the heading and the routine repetition.", | |||||||||||||||||||||||||||||||||||||||||||||||
( f ) the substitution in Regulation 27 (1) for "8p" (inserted by Regulation 3 (1) (c) of the 1977 Warrant) of "10p"; | |||||||||||||||||||||||||||||||||||||||||||||||
( g ) the substitution in Regulation 32 (2), as amended by Regulation 13 of the 1955 Warrant, for references to "70p" and "78p" (inserted by Regulation 3 (1) (d) of the 1977 Warrant) of reference to "84p" and "94p", respectively; | |||||||||||||||||||||||||||||||||||||||||||||||
( h ) the substitution in sub-paragraph (c) of paragraph (2) of Regulation 33 for "£8.75" (inserted by Regulation 3 (1) (e) of the 1977 Warrant) of "£10.50"; | |||||||||||||||||||||||||||||||||||||||||||||||

(2) Regulation 7 (1), 27 (1), 32 (2 (2), 33 (2) (c), 34 (2) (a) and 34 (2) (b) of the 1920 Regulations, as amended by paragraph (1) of this Regulation, are set out in paragraphs (1), (2), (3), (4) and (5) respectively, of the Table of this Warrant. 4. (2) Regulations 4,5,6,7 (1), 7 (6) (a), 9 (1), 10 and 16 of the 1955 Warrant, as amended by paragraph (1) of this Regulation, are set out in paragraphs (6), (7), (8), (9), (10), (11), (12) and (13) respectively of the Table to this Warrant. 5. The following are hereby revoked:— | |||||||||||||||||||||||||||||||||||||||||||||||
( a ) subparagraph (a) of paragraph (2) of Regulation 7 of the 1955 Warrant; | |||||||||||||||||||||||||||||||||||||||||||||||
( b ) in paragraph (5) of the said Regulation 7, all the words after "under this Regulation". | |||||||||||||||||||||||||||||||||||||||||||||||
TABLE | |||||||||||||||||||||||||||||||||||||||||||||||
(1) 7.—(1) Subject to the provisions of these Regulations, there shall be charged and paid for the delivery of a Telegram by a special messenger at an address beyond the limits of free delivery the sum of 10p for any distance which is a multiple of sixteen hundred metres and for any distance part of a multiple of sixteen hundred metres from the boundary of the free delivery area. | |||||||||||||||||||||||||||||||||||||||||||||||
(2) 27. The sender of a telegram may cancel it before delivery to the addressee, subject to the following provisions:— | |||||||||||||||||||||||||||||||||||||||||||||||
(1) If the application for cancellation be made before the transmission of the telegram from the office of origin has commenced, the sum prepaid for transmission less the sum of 10p, together with any sum prepaid for delivery, shall be returned. | |||||||||||||||||||||||||||||||||||||||||||||||
(3) 32.—(2) There shall be charged and paid in respect of each retransmission the same charges as would be payable on the original transmission of the Telegram to the second address. Provided that when the Postmaster-General deems it just so to do he may substitute a fixed charge of 84p in respect of a telegram within the State or of 94p in respect of a telegram to a place within the British Telegraph Administration for all other charges for redirected and re-transmission. | |||||||||||||||||||||||||||||||||||||||||||||||
(4) 33.—(2) (c) There shall be paid for such registration such yearly sum (not exceeding £10.50, and hereinafter called a registration fee) as the Postmaster-General may from time to time prescribe and such registration fee shall be paid in advance. | |||||||||||||||||||||||||||||||||||||||||||||||
(5) 34.—(2) (a) In respect of special instructions in the case of a change of residence or place of business, the sum of 25p shall be paid in advance at the time of registration if such instructions are not applicable to a longer period than one week, and the sum of 52p if the instructions are not applicable to a longer period than one month. In all other cases in which such instructions are registered the sum of £4.50 shall be paid in advance at the time of registration, and when such instructions are applicable to a longer period than a year the sum payable shall be £4.50 per annum. | |||||||||||||||||||||||||||||||||||||||||||||||
(b) In respect of other special instructions as to the delivery of telegrams the sum of 105p shall be paid in advance at the time of registration. | |||||||||||||||||||||||||||||||||||||||||||||||
(6) 4. Subject to the provisions of this Warrant, there shall be charged and paid for the transmission of a telegram, other than an overnight telegram within the State:— | |||||||||||||||||||||||||||||||||||||||||||||||
( a ) if the length of the telegram does not exceed twelve words, 100p; | |||||||||||||||||||||||||||||||||||||||||||||||
( b ) if the length of the telegram exceeds twelve words 100p for the first twelve words and 7p for each additional word. | |||||||||||||||||||||||||||||||||||||||||||||||
(7) 5. Subject to the provisions of this Warrant, there shall be charged and paid for the transmission of a telegram addressed to a place within the British Telegraph Administration: | |||||||||||||||||||||||||||||||||||||||||||||||
( a ) if the length of the telegram does not exceed twelve words, 107p; | |||||||||||||||||||||||||||||||||||||||||||||||
( b ) if the length of the telegram exceeds twelve words 107p for the first twelve words and 10p for each additional word. | |||||||||||||||||||||||||||||||||||||||||||||||
(8) 6. In respect of a telegram tendered on Sunday, Good Friday or a public holiday, there shall be charged and paid 16p in addition to the amount payable under Regulation 4 or Regulation 5 (as may be appropriate) of this Warrant. | |||||||||||||||||||||||||||||||||||||||||||||||
(9) 7.—(1) Subject to the conditions specified in paragraph (2) of this Regulation being satisfied, there shall be charged and paid for a telegram addressed to a newspaper, newsagency, newsroom, club or exchange room and containing matter intended for publication as news (excluding (i) letters to the editor of a newspaper and (ii) advertisements, notices, and articles which are not normally published without charge)— | |||||||||||||||||||||||||||||||||||||||||||||||
( a ) for a telegram within the State, for each 60 words or part thereof, 100p; | |||||||||||||||||||||||||||||||||||||||||||||||
( b ) for a telegram addressed to a place within the British Telegraph Administration (for each 60 words or part thereof, 107p. | |||||||||||||||||||||||||||||||||||||||||||||||
(10) 7.—(6) (a) A telegram transmitted under this Regulation may at the request of the sender be delivered at several addresses within the limit of the free delivery of the terminal telegraph office. In such cases there shall be charged and paid for the delivery of the telegram at each address after the first the sum of 7p for each 60 words or part thereof. Subject to the foregoing provision of this sub-paragraph, each transmission of the telegram to a separate address shall be charged for as the transmission of a separate telegram. | |||||||||||||||||||||||||||||||||||||||||||||||
(11) 9.—(1) Subject to the provisions of this Warrant, there shall be charged and paid for the transmission of an overnight telegram: | |||||||||||||||||||||||||||||||||||||||||||||||
( a ) if the length of the telegram does not exceed twelve words 24p, | |||||||||||||||||||||||||||||||||||||||||||||||
( b ) if the length of the telegram exceeds twelve words 24p for the first twelve words and 4p for each additional word. | |||||||||||||||||||||||||||||||||||||||||||||||
(12) 10. The sender of a telegram may pay for the transmission of a reply thereto at the appropriate rate or rates but the sum so paid shall not— | |||||||||||||||||||||||||||||||||||||||||||||||
( a ) in the case of a telegram within the State be less than 100p or exceed £1.91p and | |||||||||||||||||||||||||||||||||||||||||||||||
( b ) in the case of a telegram to a place within the British Telegraph Administration, be less than £2.13 or exceed £3.31. | |||||||||||||||||||||||||||||||||||||||||||||||
(13) 16. There shall be charged and paid for a telegram applying for a withdrawal from the Post Office Savings Bank, Dublin 84p and for the reply telegram authorising the withdrawal from the Savings Bank 84p. | |||||||||||||||||||||||||||||||||||||||||||||||
