S.I. No. 101/1980 - European Communities (Agricultural Or Forestry Tractors Type Approval) Regulations, 1980.

I, RAY MAC SHARRY, Minister for Agriculture, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to the Community Directives referred to in Regulation 6 of the following Regulations, in so far as those Directives apply to the type approval of agricultural or forestry tractors and components, hereby make the following Regulations:

1. These Regulations may be cited as the European Communities (Agricultural or Forestry Tractors Type Approval) Regulations, 1980, and shall come into operation on the 15th day of April, 1980.

2. In these Regulations "the Regulations of 1979" means the European Communities (Agricultural or Forestry Tractors Type Approval) Regulations, 1979 ( S.I. No. 137 of 1979 ).

3. Regulation 2 of the Regulations of 1979 is hereby amended by the substitution of the following definition for the definition of "component":

" 'Component' in relation to a tractor, means a part, aspect or feature (including a system or part which forms a separate technical unit) which is the subject of a scheduled Directive and includes any part of the equipment of a tractor and anything intended for the protection of a person in a tractor, whether or not it forms part of the tractor;".

4. The following Regulation is hereby substituted for Regulation 8 of the Regulations of 1979:

" 8. (1) The manufacturer (or his authorised representative) of a type tractor in respect of which a type approval certificate has been issued and is in force shall, in respect of each tractor manufactured in conformity with the type tractor, complete a certificate of conformity.

(2) The manufacturer (or his authorised representative) of a separate technical unit of a type which has been granted type approval shall affix to each unit manufactured in conformity with the approved type the trade name or mark, the type and (if the appropriate scheduled directive so requires) the type approval number.".

5. The following Regulation is hereby substituted for Regulation 11 of the Regulations of 1979:

" 11. The manufacturer of a tractor approved under Regulation 5 of these Regulations shall cause it to be fitted with a roll-over protection structure which satisfies the relevant provisions of either the Directive referred to at reference number 11 of Schedule 1 to these Regulations or the Directive referred to at reference number 17 of that Schedule.".

6. The following Schedule is hereby substituted for Schedule 1 to the Regulations of 1979:

EXPLANATORY NOTE

The Regulations amend the European Communities (Agricultural or Forestry Tractors Type Approval) Regulations, 1979 which implement those provisions of certain EEC Directives (listed in Regulation 6) relating to the type approval of agricultural or forestry tractors having a maximum design speed of between 6 and 25 Km/h and components of such tractors.
