HARBOUR RATES (HARBOURS IN COUNTY DONEGAL) ORDER, 1981.

I, Albert Reynolds, Minister for Transport, in exercise of the powers conferred on me by section 3 of the Harbours (Regulation of Rates) Act, 1934 (No. 2 of 1934), the Transport, Fuel and Power (Transfer of Departmental Administration and Ministerial Functions) Order, 1959 ( S.I. No. 125 of 1959 ), and the Tourism and Transport (Alteration of Name of Department and Title of Minister) Order, 1980 ( S.I. No. 11 of 1980 ), and after due compliance with section 5 of that Act, hereby order as follows:

1. (1) This Order may be cited as the Harbour Rates (Harbours in County Donegal) Order, 1981.

(2) This Order shall come into operation on the 14th day of March, 1981.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

3. The rates set out in the First Schedule to this Order are hereby fixed as the maximum rates to be charged by the council of the county of Donegal in respect of the harbours, piers, quays and landing places specified in the Second Schedule to this Order.

4. Every statutory or other provision fixing, restricting or otherwise regulating the rates or the maximum or minimum rates chargeable by the council of the county of Donegal on subjects of charge set out in the First Schedule to this Order, or the basis on which or the method by which such rates are computed, is hereby revoked.

FIRST SCHEDULE.

MAXIMUM RATES.

(a) boats up to 40 feet in length ...

£1 for each entry into harbour, or £10 for each year payable in advance on each 1st day of October.

(b) boats of 40 feet or more in length but less than 75 feet in length

£1 for each entry into harbour, or £15 for each year payable in advance on each 1st day of October.

(c) boats of 75 feet or more in length but less than 100 feet in length

£1 for each entry into harbour, or £20 for each year payable in advance on each 1st day of October.

(d) boats of 100 feet or more in length

£1 for each entry into harbour, or £25 for each year payable in advance on each 1st day of October.

2.

Charges for fish landed:—

(a) Herrings

£0.03 per box or £0.60 per tonne of 22 boxes.

(b) Fresh fish other than herrings

£0.03 per box or £0.60 per tonne of 22 boxes.

(c) Lobsters

Free.

3.

Tonnage rates on boats and vessels (other than fishing boats):

(a) for every vessel loading or unloading cargo

£0.10 on every ton of—

(a) the net registered tonnage, or

(b) 50% of the gross tonnage whichever is the greater.

(b) for motor boats and like craft carrying goods or passengers, for each day such boat enters a harbour or anchors or moors at, or comes along-side a pier, a fee, in lieu of tonnage rates of

£1.00 per entry.

(c) for pleasure boats using a harbour

£1.00 per entry.

(d) for every vessel occupying a berth in a harbour for a period exceeding 14 days, for each day exceeding 14 days, a charge per net registered ton of

£0.02 per ton.

Rates for goods and livestock shipped or unshipped, received or delivered within a harbour:—

(a) Coals, solid fuels, culm and kelp

£0.06 per tonne.

(b) cured or salted fish

£0.03 per barrel.

(c) empties

£0.02 per empty

(d) flour

£0.10 per tonne

(e) grain

£0.10 per tonne

(f) manure

£0.10 per tonne.

(g) limestone, sand, granite or other stone

£0.10 per tonne.

(h) potatoes

£0.10 per tonne.

(i) salt

£0.04 per tonne.

(j) slates

£0.10 per tonne.

(k) timber

£0.10 per tonne.

(l) horses, cows, bullocks and other large animals

£0.10 each.

(m) calves, sheep, pigs and other small animals

£0.05 each.

5.

Charge for use of fresh water

£0.10 per 1,000 gallons.
