S.I. No. 323/1981 - Road Transport Act, 1978 (Section 5) (No. 2) Order, 1981.

I, PATRICK COONEY, Minister for Transport, in exercise of the powers conferred on me by section 5 of the Road Transport Act, 1978 (No. 8 of 1978), and the Tourism and Transport (Alteration of Name of Department and Title of Minister) Order, 1980 ( S.I. No. 11 of 1980 ), hereby order as follows:

1. This Order may be cited as the Road Transport Act, 1978 (Section 5) (No. 2) Order, 1981.

2. The classes of international transport by road which are specified in paragraphs (a) to (p) of Article 4 of the agreement made on the 19th day of May, 1981, between the Government and the Government of Sweden on the international carriage of goods by road (being an international agreement relating to international transport by road), and which are set out in the Schedule to this Order, are hereby exempted from the provisions of section 7 of the Road Transport Act, 1935 (as amended or extended).

SCHEDULE.

Classes of International Transport by Road referred to in paragraph 2:

(a) transport of goods carried on an occasional basis to or from airports, in cases where services are diverted;

(b) transport of luggage carried on trailers attached to passenger transport vehicles, and luggage carried on vehicles of any type to or from airports;

(c) transport of mails;

(d) transport of damaged or broken-down vehicles;

(e) transport of bees and fish stock;

(f) funeral transport;

(g) transport of goods on own account, provided an appropriate own account document is carried on the vehicle;

(h) transport of spare parts and provisions for ocean going ships;

(i) transport of precious goods, for example precious metals, in special vehicles accompanied by the police or other security personnel;

(j) transport of medical supplies and equipment needed for emergencies, notably in the event of natural disasters;

(k) transport of goods in vehicles whose permitted gross laden weight, including trailers, does not exceed 6 tonnes, or where the permitted payload, including trailers, does not exceed 3.5 tonnes;

(l) unladen run of a relief vehicle used for transporting goods sent to replace a vehicle which has broken down in another country, and continuation of the haul by the relief vehicle under cover of the permit issued for the vehicle which has broken down;

(m) transport of works and objects of art for fairs and exhibitions or for commercial purposes;

(n) transport of articles and equipment intended exclusively for advertising and information purposes;

(o) transport of properties, accessories and animals to or from theatrical, musical, film, sports or circus performances, fairs or fetes, and those intended for radio recordings, or for film or television production;

(p) unladen runs by vehicles.

The effect of this Order is that a licence under Section 7 of the Road Transport Act, 1935 is not required in respect of the classes of international transport by road specified in paragraphs (a) to (p) of Article 4 of the Road Transport Agreement between the Government and the Government of Sweden dated 19th May, 1981, and set out in the Schedule to this Order.
