S.I. No. 266/1984 - Food Standards (Fruit Juices and Fruit Nectars) (European Communities) (Amendment) Regulations, 1984.


I, JOHN BRUTON, Minister for Industry, Trade, Commerce and Tourism, in exercise of the powers conferred on me by section 2 of the Food Standards Act, 1974 (No. 11 of 1974), and the Industry (Alteration of Name of Department and Title of Minister) Order, 1983 ( S.I. No. 384 of 1983 ), and having consulted the Minister for Agriculture and the Minister for Health and such organisations as appear to me to be interested to a substantial extent in the subject matter, hereby make the following Regulations:

1. These Regulations may be cited as the Food Standards (Fruit Juices and Fruit Nectars) (European Communities) (Amendment) Regulations, 1984.

2. A word or expression that is used in these Regulations and is also used in the Council Directive has, unless the contrary intention appears, the meaning that it has in that directive.

3. The Food Standards (Fruit Juices and Fruit Nectars) (European Communities) Regulations, 1978 ( S.I. No. 173 of 1978 ), are hereby amended by—

( a ) the substitution of the following definition for the definition of "the Council Directive" in Regulation 2(1) of the said Regulations,

'"the Council Directive' means Council Directive No. 75/726/EEC of 17 November, 19751 as amended by Council Directive No. 79/168/EEC of 5 February, 19792 and Council Directive No. 81/487/EEC of 30 June 19813;",

( b ) the substitution of the following definition for the definition of "dilution" in Regulation 2(1) of the said Regulations,

'"dilution', in relation to concentrated fruit juice, means

( a ) in case the juice is intended for direct consumption, dilution with the quantity of water which is appropriate having regard to the statement referred to in paragraph (4) (c) of Article 11 of the Council Directive and required by the said Article 11 to be on the package, container or accompanying documents,

( b ) in any other case, such dilution as is appropriate.", and

( c ) the substitution of the following Regulation for Regulations 4 and 5:

"4. A person shall not market a product referred to in paragraphs (5) to (8) of Article 1 of the Council Directive unless it conforms to the definitions and rules laid down in the Council Directive and the annex thereto for that product and in case the sulphur dioxide content of any product is greater than 10 mg per litre, the words "contains preservative" or "contains permitted preservative" or a statement to the like effect shall be used on the package or container which contains the product, or on a label attached to such package or container, and such words or statement shall be indelible, readily legible and in distinctive characters of uniform colour and size.".

EXPLANATORY NOTE.

The purpose of these Regulations is to amend the Food Standards (Fruit Juices and Fruit Nectars) (European Communities) Regulations, 1978 ( S.I. No. 173 of 1978 ) to give legal effect to EEC Council Directives 79/168 and 81/487, both of which amend EEC Council Directive 75/726 on the approximation of the laws of the Member States concerning fruit juices and certain similar products.

These Regulations should be read together with the Council Directives.
