CORK DISTRICT MILK BOARD (LEVY) (AMENDMENT) REGULATIONS, 1985.

I, AUSTIN DEASY, Minister for Agriculture, in exercise of the powers conferred on me by section 4 of the Milk (Regulation of Supply and Price) Act, 1936 (No. 43 of 1936), and by section 41 (as amended by section 19 of the Milk (Regulation of Supply and Price) (Amendment) Act, 1941 (No. 11 of 1941), and section 7 of the Milk (Regulation of Supply and Price) (Amendment) Act, 1952 (No. 9 of 1952)) of that Act, do hereby order and make the following regulations:

1. These Regulations may be cited as the Cork District Milk Board (Levy) (Amendment) Regulations, 1985.

2. In these Regulations—

"the Board" means the Cork District Milk Board;

"the section" means section 41 of the Milk (Regulation of Supply and Price) Act, 1936 (No. 43 of 1936), as amended by section 19 of the Milk (Regulation of Supply and Price) (Amendment) Act, 1941 (No. 11 of 1941), and section 7 of the Milk (Regulation of Supply and Price) (Amendment) Act, 1952 (No. 9 of 1952).

3. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

4. (1) For the purposes of the levy payable to the Board under subsection (1) (b) of the section.

( a ) the prescribed sum shall, in respect of the month of July, 1985 and each subsequent month, be 0.862 new pence;

( b ) regulation 4(1) (a) of the Cork District Milk Board (levy) (Amendment) Regulations, 1973 ( S.I. No. 106 of 1973 ), shall not apply in relation to any such month.

(2) For the purposes of the levy payable to the Board under subsection (2) (b) of the section:

( a ) the prescribed sum shall, in respect of the month of July, 1985 and each subsequent month, be 0.862 new pence;

( b ) regulation 4(2) (a) of the Regulations mentioned in paragraph (1) (b) shall not apply in relation to any such month.

5. The Cork District Milk Board (levy) (Amendment) Regulations 1973 ( S.I. No. 106 of 1973 ) are hereby revoked with effect from the 1st day of July, 1985.

EXPLANATORY NOTE.

These Regulations prescribe the amount of the milk levy payable by registered retailers and registered wholesalers and by certain registered producers as from 1 July 1985.
