DISTRICT COURT AREAS (AMENDMENT) AND VARIATION OF DAYS ORDER, 1985.

I, MICHAEL NOONAN, Minister for Justice, in exercise of the powers conferred on me by section 26 (1) of the Courts of Justice Act, 1953 (No. 32 of 1953), and after consultation with the President of the District Court, hereby order as follows:

1. (1) This Order may be cited as the District Court Areas (Amendment) and Variation of Days Order, 1985.

(2) This Order shall come into operation on the 1st day of January, 1986.

2. In this Order—

"the Principal Order" means the District Court (Areas) Order, 1961 ( S.I. No. 5 of 1961 );

"the Order of 1985" means the District Court Districts and Areas (Amendment) and Variation of Days and Hours Order, 1985 ( S.I. No. 353 of 1985 ).

3. The district court area of Galway is hereby varied by the substitution for the matter in column (5) at reference number 88 in the First Schedule and at reference number 77 in the Second Schedule (as amended by the Order of 1985), to the Principal Order, of the following:

"The area comprising—

( a ) the county borough of Galway,

( b ) the District Electoral Divisions of Ballynacourty, Carnmore, Claregalway, Clarinbridge, Moycullen, Oranmore, Tullokyne in the county of Gaway, and

( c ) those parts of the District Electoral Divisions of Ballintemple, Barna, Carrowbrowne and Galway Rural which are in the county of Galway."

4. The days for holding the District Court in the district court area of Gort shall, in lieu of the days (inserted by the Order of 1985) specified in column (4) at reference number 90 in the First Schedule, and at reference number 79 in the Second Schedule, to the Principal Order, be the fourth Monday in each month and the second Wednesday in February, June, October and December.

5. Business transacted in the District Court which is initiated and is not completed before the commencement of this Order shall be continued and completed as if this Order had been in force at the time at which such business was initiated.

EXPLANATORY NOTE.

This Order provides for a re-definition of the area comprising the District Court Area of Galway consequent to the establishment of the Borough of Galway as the County Borough of Galway.

The Order also provides for a variation in the present arrangements for the holding of sittings of the District Court in Gort.
