ROAD TRAFFIC (SPEED LIMITS) (COUNTY OF OFFALY) REGULATIONS, 1989. | ||
The Minister for the Environment in exercise of the powers conferred on him by sections 5 and 45 of the Road Traffic Act, 1961 (No. 24 of 1961), and section 46 of the said Act as amended by section 25 of the Road Traffic Act, 1968 (No. 25 of 1968), hereby makes the following Regulations:— | ||

1 Citation. | 1. These Regulations may be cited as the Road Traffic (Speed Limits) (County of Offaly) Regulations, 1989. | |
|
2 Commencement. | 2. These Regulations shall come into operation on the 10th day of July, 1989. | |
|
3 Interpretation. | 3. In these Regulations save where the context otherwise requires— | |
"the Act" means the Road Traffic Act, 1961 ; | ||
"national road" means a road declared to be a national road in the Local Government (Roads and Motorways) Act, 1974 (Declaration of National Roads) Order, 1977 ( S.I. No. 164 of 1977 ), and any reference to the number of such road shall be a reference to the number of such road as shown in column 1 of the First Schedule or column 1 of the Second Schedule to the aforementioned Order; | ||
"road" means a public road; | ||
"perimeter road" means a road on and along the roadway of which there runs the boundary of an urban district; | ||
"special speed limit" and "built-up area speed limit" have the meanings respectively assigned to them in Part IV of the Act; | ||
"distance" means distance as measured along the centre line of a road. | ||

4 Built-up area speed limit. | 4. (1) Each of the roads described in the First Schedule to these Regulations is hereby declared not to be a public road in a built-up area for the purposes of section 45 of the Act. | |
(2) Each of the roads described in the Second Schedule to these Regulations is hereby declared to be a public road in a built-up area for the purposes of section 45 of the Act. | ||

5 Special speed limit. | 5. Forty miles per hour shall be the speed limit for mechanically propelled vehicles on the roads specified in the Third Schedule to these Regulations. | |
|
6 Exceptions. | 6. There shall be excepted from the special speed limit prescribed in Article 5 of these Regulations and from the built-up area speed limit the following:— | |
(a) ambulances, | ||
(b) fire brigade vehicles, and | ||
(c) vehicles used by members of the Garda Síochána in the performance of their duties as such members. | ||

7 Revocation. | 7. The Road Traffic (Speed Limits) (County of Offaly) Regulations, 1983 ( S.I. No. 81 of 1983 ), are hereby revoked. | |

FIRST SCHEDULE | ||
Roads in the county of Offaly declared not to be public roads in a built-up area for the purposes of section 45 of the Road Traffic Act, 1961 . | ||
1. The following roads in the urban district of Birr:— | ||
(a) The Croghan Road. | ||
(b) The Banagher Road for a distance of 777 metres from the point where the urban district boundary intersects the eastern side of the road. | ||
(c) The Athlone Road (National Road N62) for a distance of 740 metres from the point where the urban district boundary intersects the western side of the road. | ||
(d) Burke's Hill Road for a distance of 1,052 metres from its junction with the New Line. | ||
(e) The Kinnitty Road between the point where the urban district boundary intersects the northern side of the road at Springfield Bridge and a point 782 metres north-west of its junction with the Whiteford Road. | ||

( a ) The Clara Road (National Road N80) between a point 438 metres south-east of the boundary of the urban district of Tullamore and a point 343 metres north-west of the said boundary. | ||
( b ) The Kilbeggan Road (National Road N52) between a point 325 metres south-east of the boundary of the urban district of Tullamore and a point 570 metres north of its junction with Collins's Lane. | ||
( c ) The Charleville Road between a point 10 metres south-west of its junction with Dillon Street and a point 125 metres south-west of its junction with the Kinnitty Road. | ||
( d ) The Mountmellick Road (National Road N80) between a point 243 metres north of the point where the boundary of the urban district of Tullamore intersects the eastern side of the road and a point 10 metres north of its junction with Coghlan's Lane. | ||
( e ) The Daingean Road between a point 3 metres east of the boundary of the urban district of Tullamore and a point 366 metres east of the said boundary. | ||
( f ) The Rahan Road between a point 210 metres north-west of the point where the boundary of the urban district of Tullamore intersects the south-western side of the road and a point 620 metres north-west of the said intersection. | ||
( g ) The Portarlington Road between a point 685 metres north-west of the point where the boundary of the urban district of Tullamore intersects the southern side of the road and a point 20 metres north-west of the said point. | ||
( h ) The Ballard Road for a distance of 40 metres from its junction with the Birr Road. | ||
( i ) The Kinnitty Road for a distance of 130 metres from its junction with the Birr Road. | ||

EXPLANATORY NOTE. | ||
These Regulations replace the Road Traffic (Speed Limits) (County of Offaly) Regulations, 1983 ( S.I. No. 81 of 1983 ) and alter the speed limits applicable to certain roads in this area. | ||
The Regulations exclude the public roads mentioned in the First Schedule from the scope of the built-up area speed limit prescribed by section 45 of the Road Traffic Act, 1961 and declare the public roads mentioned in the Second Schedule to be subject to that limit. | ||
The Regulations also prescribe a speed limit of 40 miles per hour in respect of the public roads mentioned in the Third Schedule. | ||
Ambulances, fire brigade vehicles and Garda Síochána vehicles while being used in the course of duty are excepted from all speed limits by the Regulations. |
