FOREIGN POST AMENDMET (No. 31) SCHEME, 1989.

AN POST, in exercise of the powers conferred on it by Section 70 of the Postal and Telecommunications Services Act, 1983 (No. 24 of 1983), and with the consent of the Minister for Communications, hereby makes the following Scheme:

1. (1) This Scheme may be cited as the Foreign Post Amendment (No. 31) Scheme, 1989.

(2) This Scheme shall be operative with effect from the 1st day of January, 1990.

2. In this Scheme—

"the Principal Warrant" means the Foreign Post Warrant, 1949 ( S.I. No. 267 of 1949 ).

"Scheme No. 28" means the Foreign Post Amendment (No. 28) Scheme, 1986 ( S.I. No. 90 of 1986 ).

3. Regulation 21 of the Principal Warrant (inserted by Regulation 3 of Scheme No. 28) is hereby amended by the substitution in paragraph 4 for "seventeen pence" in both places where that amount appears and for "twenty-pence" of "twenty pence" and "twenty-three pence" respectively.

4. The First Schedule to the Principal Warrant is hereby amended by the substitution for the entries therein (inserted by Regulation 5 of the Scheme No. 28) of the entries in the First Schedule to this Scheme.

5. The Second Schedule to the Principal Warrant is hereby amended by the substitution for the entries therein (inserted by Regulation 4 of the Foreign Post Amendment (No. 30) Scheme, 1989) of the entires in the Second Schedule to this Scheme.

6. The Fourth Schedule to the Principal Warrant is hereby amended by the substitution for the entires therein (inserted by Regulation 8 of the Scheme No. 28) of the entries in the Third Schedule to this Scheme.

7. Regulation 4 of the Foreign Post Amendment (No. 4) Warrant, 1956 ( S.I. No. 148 of 1956 ), is hereby amended by the substitution in paragraph 1 for "printed packets" of "letter packets".

8. The following regulation is hereby substituted for Regulation 7 of the Foreign Post Amendment (No. 26) Scheme, 1985 ( S.I. No. 139 of 1985 ):

"7. (1) There shall be charged and paid on every mail bag containing letter post items to which this Scheme applies for every kg weight of the mail bag and its contents and for every item therein whichever of the following rates is appropriate:—

( a ) In the case of a mail bag containing packets addressed to one and the same addressee conveyed by surface means, a rate not exceeding 200p per kg.

( b ) In the case of a mail bag containing packets addressed to one and the same addressee conveyed by air over all or part of the route, a rate not exceeding 400p per kg.

( c ) In the case of a mail bag containing packets addressed to different addresses conveyed by surface means, a rate not exceeding 15p per item plus 200p per kg.

( d ) in the case of a mail bag containing packets addressed to different addresses conveyed by air over all or part of the route, a rate not exceeding 15p per item plus 500p per kg.

(2) For the purpose of paragraph (1) of this Regulation the weight of the mail bag and its contents shall be calculated to the next nearest kg."

9. Regulation 5 of the Foreign Post Amendment (No. 5) Warrant, 1957 ( S.I. No. 58 of 1957 ) (inserted by Regulation 10 of Scheme No. 28) is hereby deleted.

10. Regulation 8 of the Foreign Post Amendment (No. 27) Scheme, 1985 ( S.I. No. 95 of 1985 ), is hereby deleted.

11. The following Regulation is hereby substituted for Regulation 10 of the Foreign Post Amendment (No. 27) Scheme, 1985 ( S.I. No. 95 of 1985 ):

"10. (1) There shall be charged and paid upon Express Mail Packets the rates specified in the First Schedule to this Scheme.

(2) An Post shall determine from time to time in what destination zone a particular destination shall be included and it may proclaim such determination from time to time by public notice, advertisement or otherwise as it sees fit."

and the First Schedule to the said Scheme, as inserted by the First Schedule to the Foreign Post Amendment (No. 29) Scheme, 1986 ( S.I. No. 91 of 1986 ), shall be replaced by the Fourth Schedule to this scheme, and the Second Schedule to the said Scheme is hereby deleted.

12. The First Schedule to the Foreign Post Amendment (No. 27) Scheme, 1985 ( S.I. No. 95 of 1985 ), is hereby amended by the substitution for the entries therein (inserted by Regulation 3 of the Foreign Post Amendment (No. 29) Scheme, 1986 ( S.I. No. 91 of 1986 )) of the entries in the Fourth Schedule to this Scheme.

SECOND SCHEDULE

"

1. Late Fee Postal Packet

A fee (in addition to the postage) not exceeding 12p, as may be prescribed.

2. Customs Clearance Fee on incoming postal packet from non EC Countries liable to Customs Duty

A fee of 120p per packet.

3. Express postal packet— outgoing

A fee not exceeding 150p as may be prescribed.

Express postal packet— incoming

At the scale of fees in force for express delivery of Inland postal packets.

4. Ordinary registration

A fee of 100p per packet.

Late fee registration

A fee (in addition to the ordinary registration fee) not exceeding 14p as may be prescribed.

5. Advice of delivery

A fee of 34p per registered postal packet.

EXPLANATORY NOTE

This Scheme applies to the Foreign Post Service and comes into operation on 1st January, 1990. It authorises increases in the postage rates for letters, postcards and certain other items, increases in the rates for Express Mail Services and increases in the fees for miscellaneous services. It also authorises An Post to extend the bulk post services to include all letter post items.
