OIREACHTAS (TERMINATION ALLOWANCE) (AMENDMENT) REGULATIONS, 1993.

I, BERTIE AHERN, Minister for Finance, in exercise of the powers conferred on me by section 5 of the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1992 (No. 3 of 1992), hereby make the following Regulations:

1. These Regulations may be cited as the Oireachtas (Termination Allowance) (Amendment) Regulations, 1993.

2. These Regulations shall be deemed to have come into operation on the 1st day of January, 1993.

3. Where, in accordance with the provisions of the Oireachtas (Termination Allowance) Regulations, 1992 ( S.I. No. 356 of 1992 ), a lump sum payment is payable to a person with effect from any date during the period commencing on the 1st day of January, 1993, and ending on the 30th day of November, 1993, then notwithstanding the provisions of Regulation 8 of those Regulations, the amount of the payment shall be calculated as if, during the aforesaid period, the annual rate of the salary payable to a member of the Oireachtas was—

( a ) £30,877 in the case of a member of Dáil Éireann, and

( b ) £17,904 in the case of a member of Seanad Éireann.

EXPLANATORY NOTE.

These Regulations provide that lump sum payments granted to outgoing members of the Oireachtas under the Oireachtas (Termination Allowance) Regulations, 1992, shall, if payable with effect from a date between 1 January 1993 and 30 November 1993, be based on the rates of salary which are due to be paid to members of the Oireachtas with effect from 1 December 1993, under the Public Service Pay Agreement which forms part of the Programme for Economic and Social Progress. This provision is in accordance with arrangements applicable to all staff covered by that Agreement.
