COLLISION REGULATIONS (SHIPS AND WATER CRAFT ON THE WATER) (AMENDMENT) ORDER, 1993. | ||
THE GOVERNMENT, in exercise of the powers conferred on them by sections 418 and 424 of the Merchant Shipping Act, 1894, as adapted, and by section 58 of the Air Navigation and Transport Act, 1936 (No. 40 of 1936), hereby, on the recommendation of the Minister for the Marine and the Minister for Transport, Energy and Communications order as follows:— 1. (1) This Order may be cited as the Collision Regulations (Ships and Water Craft on the Water) (Amendment) Order, 1993. | ||
(2) This Order shall come into operation on the first day of October, 1993. 2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order. 3. The Collision Regulations (Ships and Water Craft on the Water) Order, 1984 ( S.I. No. 29 of 1984 ), are hereby amended by— | ||
the substitution of the following paragraph for paragraph ( d ) of Rule 10 of the First Schedule: | ||
"( d ) (i) A vessel shall not use an inshore traffic zone when she can safely use the appropriate traffic lane within the adjacent traffic separation scheme. However, vessels of less than 20 metres in length, sailing vessels and vessels engaged in fishing may use the inshore traffic zone. | ||
(ii) Notwithstanding subparagraph ( d ) (i), a vessel may use an inshore traffic zone when en route to or from a port, offshore installation or structure, pilot station or any other place situated within the inshore traffic zone or to avoid immediate danger." 4. The Collision Regulations (Ships and Water Craft on the Water) Order, 1984 ( S.I. No. 29 of 1984 ); the Collision Regulations (Ships and Water Craft on the Water) (Amendment) Order, 1990 ( S.I. No. 36 of 1990 ) and this Order may be cited collectively as the Collision Regulations (Ships and Water Craft on the Water) Orders, 1984 to 1993. | ||

EXPLANATORY NOTE. | ||
This Order amends the Collision Regulations (Ships and Water Craft on the Water) Order, 1984 ( S.I. No. 29 of 1984 ) in order to provide for an amendment to the International Regulations for Preventing Collisions at Sea, 1972 as adopted by the International Maritime Organisation and which came into force on 19 April, 1991. The amendment clarifies the position with regard to the use of inshore traffic zones — the areas which lie between the lanes prescribed in the traffic separation scheme and the coast — by vessels engaged in fishing and by other vessels when en route to or from a port, offshore installation or structure, pilot station or any other place situated within the inshore traffic zone or to avoid immediate danger. |
