SOCIAL WELFARE (FAMILY INCOME SUPPLEMENT) (AMENDMENT) REGULATIONS, 1994.

The Minister for Social Welfare in exercise of the powers conferred on him by sections 4 and 202 of the Social Welfare (Consolidation) Act, 1993 (No. 27 of 1993) hereby makes the following Regulations:—

1 Construction and citation.

1. (1) These Regulations may be cited as the Social Welfare (Family Income Supplement) (Amendment) Regulations, 1994.

(2) These Regulations and the Social Welfare (Family Income Supplement) Regulations, 1991 ( S.I. No. 279 of 1991 ) shall be construed together as one and may be cited together as the Social Welfare (Family Income Supplement) Regulations, 1991 and 1994.

2 Interpretation.

2. In these Regulations "the Principal Regulations" means the Social Welfare (Family Income Supplement) Regulations, 1991 ( S.I. No. 279 of 1991 ).

3 Calculation of weekly family income.

3. Article 5 (1) (a) of the Principal Regulations is hereby amended by the substitution of "four weeks" for "six weeks".

4 Circumstances in which a person is to be regarded as being in remunerative full-time employment.

4. Article 7 (1) of the Principal Regulations is hereby amended by the insertion in paragraphs (a) and (b) after "remunerative employment" of "(other than employment under a scheme administered by An Foras Áiseanna Saothair and known as Community Employment)".

EXPLANATORY NOTE.

These Regulations provide for a reduction, from 6 to 4 weeks, in the period over which a person's income comprising earnings from employment as an employee is assessed in the case of Family Income Supplement for the purpose of calculating the weekly family income.

Under existing provisions, people participating in a Social Employment Scheme are not regarded as being in remunerative full-time employment for Family Income Supplement purposes. These Regulations make similar provision for people participating in Community Employment, which incorporates the former Social Employment scheme.
