FRIENDLY SOCIETIES (FEES) REGULATIONS, 1995.

The Minister for Enterprise and Employment, in exercise of the powers conferred on him by section 96 of the Friendly Societies Act, 1896, as adapted by section 2 of the Registry of Friendly Societies Act, 1936 (No. 51 of 1936), and the Industry and Commerce (Alteration of Name of Department and Title of Minister) Order, 1993 ( S.I. No. 19 of 1993 ), hereby, with the consent of the Minister for Finance, makes the following Regulations:

1. These Regulations may be cited as the Friendly Societies (Fees) Regulations, 1995.

2. These Regulations shall come into operation on the 1st day of February, 1995.

3. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

4. (1) The fees to be paid for matters to be transacted or for the inspection of documents under the Friendly Societies Acts, 1896 to 1977, shall be the fees that are specified in Part I of the Schedule to these Regulations.

(2) No fee shall be payable for the services specified in Part II of the Schedule to these Regulations.

5. The Friendly Societies (Fees) Regulations, 1983 ( S.I. No. 290 of 1983 ), are hereby revoked.

( a ) Complete amendment

5.

Registry of a special resolution by any society (including approval of a change of name).

9.

Determination of a Registrar on a dispute or his award for dissolution or distribution of funds:

(i) where the matter is settled without a hearing or on one hearing without an adjournment;

(ii) where more than one hearing is required the same fee as at (i) together with for every hearing after the first and for every adjournment;

£50.00

(iii) award for appropriation or division of assets of a society or branch—

( a ) where the assests do not exceed £200

£50.00

( b ) for every additional £100

£10.00

Provided that where application is made for investigation into the affairs of a society with a view to dissolution thereof on the grounds that the rates of contribution fixed in the rules of the society are insufficient to cover the benefits assured, the Registrar, before making his award, may require the payment of such fees as he deems fit not exceeding the relevant fees specified at ref. no. 21.

Order dispensing with consent and conditions for amalgamation or transfer of engagements—

(i) where the matter is settled without a hearing or on one hearing

£50.00

(ii) for every hearing after the first and for every adjournment

£50.00

11.

Signature or seal of the Registrar to a document not chargeable with any other fee

£21.00

12.

Inspection of a society's file

£5.00

Provided that the Registrar may dispense with the fee in cases where he considers that it is in the public interest so to do.

13.

Copy of extract of any document (in addition to fee for Registrar's signature)

20 pence per photostat copy of any page or extract of any document or portion of any page or extract thereof.

14.

Photocopying Handling Fee

10 pence per photostat sheet once number of photostat sheets exceeds ten.

15.

Printouts of names and addresses of Societies

20 pence per Society name and address.

16.

Filing of notice of change of registered office

£30.00

17.

Filing of notice of appointment of trustees

£30.00

18.

Filing of a society's annual return

£50.00

19.

Registry of a valuation where the society has been suspended for default in furnishing the valuation

Fee equal to cost of advertisement plus £20.00

20.

Exemption from valuation of society which periodically divides its funds or in the case of any society where the requirement has been dispensed with pursuant to Section 28 (5) of the Friendly Societies Act, 1896.

21.

Where a society desires its valuation to be carried out by an actuary to be named by the Registrar:

If the number of members does not exceed 150

£150.00

If over 150 but not exceeding 250

£200.00

If over 250 but not exceeding 350

£250.00

If over 350 but not exceeding 500

£300.00

If over 500 but not exceeding 700

£400.00

If over 700 but not exceeding 1,000

£500.00

For every 500 members or portion thereof exceeding 1,000

An additional £100.00

22.

Notice of establishment of a branch, or the rules of such branch or any amendment thereto

£20.00

23.

Filing of an instrument of dissolution or any amendment thereto.

£100.00

PART II

SERVICES FOR WHICH NO FEE IS PAYABLE

1. Acknowledgement of registry of, or acknowledgement of registry of any amendment of rules of, all class of Societies, other than Specially Authorised Societies, under the Friendly Societies Acts, 1896 to 1977.

2. Cancellation or suspension of registry of a society.

3. Any document or copy document supplied to a public department.

4. Any document or copy document in respect of which a fee is otherwise chargeable under the Friendly Societies Acts, 1896 to 1977, or under any other Act.
