LIVESTOCK MARTS (DATE OF TEST AND NAME AND ADDRESS OF OWNER) REGULATIONS, 1997.

I, IVAN YATES, Minister for Agriculture, Food and Forestry, in exercise of the powers conferred on me by section 6 of the Livestock Marts Act, 1967 (No. 20 of 1967), hereby make the following Regulations:

1. These Regulations may be cited as the Livestock Marts (Date of Test and Name and Address of Owner) Regulations, 1997.

2. These Regulations shall come into operation on the 3rd day of February, 1997.

3. In these Regulations—

"animal" means bovine animals and sheep;

"licensee", in relation to a mart, means the holder of the licence relating to the mart;

"mart" means a place where the business of a livestock mart is carried on.

4. (1) The licensee, or the person who is for the time being in charge or control of any mart, shall ensure, where the sale of an animal is being conducted at the mart, that—

( a ) the name and address of the owner of the animal, and.

( b ) where that animal has been tested for either or both of bovine tuberculosis and bovine brucellosis under the Diseases of Animals Act, 1966 (No. 6 of 1966), the month and year of the most recent of each of those tests,

are publicly identified in advance of that sale.

(2) Where animals are sold in lots, the month and year of test for the purpose of paragraph (1) (b) of this regulation shall be that of the animal tested earliest in that lot in respect of each disease.

EXPLANATORY NOTE.

These Regulations require that a livestock mart publicly identify the name and address of the owner of bovine animals and sheep and, where applicable, the most recent bovine tuberculosis and brucellosis test date, in advance of the sale of such animals at the mart.
