S.I. No. 300/1999 - Social Welfare (Consolidated Payments Provisions) (Amendment) (No. 6) (Bereavement Grant and Homemakers) Regulations, 1999.


The Minister for Social, Community and Family Affairs, in exercise of the powers conferred on him by sections 4 , 83 (2) (as amended by section 24 of the Social Welfare Act, 1996 (No. 7 of 1996)) and section 205 (1) of the Social Welfare (Consolidation) Act, 1993 (No. 27 of 1993), hereby makes the following Regulations:

Citation and construction.

1. (1) These Regulations may be cited as the Social Welfare (Consolidated Payments Provisions) (Amendment) (No. 6) (Bereavement Grant and Homemakers) Regulations, 1999.

(2) These Regulations and the Social Welfare (Consolidated Payments Provisions) Regulations, 1994 to 1999 shall be construed together as one and may be cited as the Social Welfare (Consolidated Payments Provisions) Regulations 1994 to 1999.

Definitions.

2. In these Regulations “the Principal Regulations” means the Social Welfare (Consolidated Payments Provisions) Regulations, 1994 ( S.I. No. 417 of 1994 ).

Bereavement grant.

3. The Principal Regulations are hereby amended by the substitution in article 100(2) and 102 (as amended by article 6(4) of the Social Welfare (Consolidated Payments Provisions) (Amendment) (No. 5) Regulations, 1996 ( S.I. No. 189 of 1996 )) for “death grant” of “bereavement grant”.

Homemakers.

4. The Principal Regulations are hereby amended by the substitution in article 102A for sub-article (2) (inserted by article 2(c) of the Social Welfare (Consolidated Payments Provisions) (Amendment) (No. 5) (Homemakers) Regulations, 1997 ( S.I. No. 293 of 1997 )) of the following sub-article:

“(2) Where a person has commenced as a homemaker on or after the 6th day of April, 1994 and not later than the 5th day of April, 1998, an application to be regarded as a homemaker shall be made not later than the 5th day of April, 2000.”.

EXPLANATORY NOTE.

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

This Regulation extends the time limit within which an application to become a Homemaker for the purposes of Old Age (Contributory) Pension may be made. The new registration deadline for an applicant who commenced home-making during the period 6th April 1994 to 5th April 1998, is 5th April, 2000.

This Regulation also replaces references to “death grant” with the new title “bereavement grant”.
