S.I. No. 29/2000 - Elections To Regional Fisheries Boards (2000 Election Application) Regulations, 2000

I, FRANK FAHEY, Minister for the Marine and Natural Resources, in exercise of the powers conferred on me by section 12 (3) (as amended) of the Fisheries Act, 1980 (No. 1 of 1980), and the Fisheries (Transfer of Departmental Administration and Ministerial Functions) Order, 1977 ( S.I. No. 30 of 1977 ) and the Marine (Alteration of Name of Department and Title of Minister) Order, 1997 ( S.I. No. 301 of 1997 ), make the following regulations:

1. These Regulations may be cited as the Elections to Regional Fisheries Boards (2000 Election Application) Regulations, 2000.

2. The Elections to Regional Fisheries Boards Regulations, 1981 ( S.I. No. 361 of 1981 ) (as amended by the Elections to Regional Fisheries Boards (Amendment) Regulations, 1986 ( S.I. No. 352 of 1986 ) and the Elections to Regional Fisheries Boards (Amendment) Regulations, 1992 ( S.I. No. 352 of 1992 )) apply to the first election of members of each regional fisheries board after the commencement of section 7 of the Fisheries (Amendment) Act, 1999 (No. 35 of 1999) to be held in the year 2000 but before 1 October of that year, with the modifications (including the modification of forms) necessary to recognise the date for the holding of the election fixed under section 7 (2) of the Fisheries (Amendment) Act, 1999 and the entitlement of a person to vote, to nominate a candidate for election, to accept nomination as a candidate and to stand as a candidate for election, as determined pursuant to section 7(6) of that Act.

3. Without limiting the generality of Regulation 2 of these Regulations, Regulation 7(1)(a) of the Elections to Regional Fisheries Boards Regulations, 1981, as amended, shall be construed as if “the latest day in the month of November” were “17 February, 2000” and Regulation 7(4) shall be construed as if “12.00 noon on the third Wednesday in November of each election year” were “12.00 noon on 17 February, 2000”.

4. For the purposes of Regulation 2 of these Regulations, substantial compliance with the forms in the Elections to Regional Fisheries Boards Regulations, 1981, as amended, shall be taken to be sufficient compliance.

These regulations provide for the application of the elections to regional fisheries boards regulations in the case of an election on 20 March 2000 with the modifications necessary due to the departure from the usual election date of the third Tuesday in December.
