S.I. No. 270/2000 - Diseases of Animals Act, 1966 (Section 54(2)) (Exemption) Order, 2000.
I, Joe Walsh, Minister for Agriculture, Food and Rural Development, in exercise of the powers conferred on me by sections 3 and 54 (2) of the Diseases of Animals Act, 1966 (No. 6 of 1966) (as adapted by the Agriculture and Food (Alteration of Name of Department and Title of Minister) Order, 1999 ( S.I. No. 307 of 1999 )), hereby order as follows: | ||||||||
1. This Order may be cited as the Diseases of Animals Act, 1966 (Section 54(2)) (Exemption) Order, 2000. | ||||||||
2. Article 4 of the Diseases of Animals Act, 1966 (Section 54) (Appointed Day and Exemptions) Order, 1967 ( S.I. No. 217 of 1967 ), is amended by the insertion after paragraph (a) of the following paragraph: | ||||||||
“(aa) any animal, in relation to which its owner has been convicted under — | ||||||||
(i) the Protection of Animals Act, 1911 (as amended by the Protection of Animals (Amendment) Act, 1965 and section 48 of the Control of Horses Act, 1996 ), in respect of the animal and who has been deprived under section 3 thereof of ownership of the animal, or | ||||||||
(ii) the Protection of Animals Kept for Farming Purposes Act, 1984 (No. 13 of 1984), in respect of the animal and consequent upon such conviction has agreed with the court not to keep the animal;”. | ||||||||

The Order adds a further exemption to the Diseases of Animals Act, 1966 (Section 54) (Appointed Day and Exemptions) Order, 1967 ( S.I. No. 217 of 1967 ). Under the latter it is an offence to sell or expose for sale, or to export or expose for export any horned cattle. The exemption relates to any horned bovine animal whose owner is required to dispose of that animal as a result of a Court Order or as a result of agreement with the Court. |
