S.I. No. 160/2001 - Diseases of Animals Act, 1966 (Foot-And-Mouth Disease) (Restriction on Movement of Persons) Order, 2001


I, Joe Walsh, Minister for Agriculture, Food and Rural Development, in exercise of the powers conferred on me by sections 3 and 15 of the Diseases of Animals Act, 1966 (No. 6 of 1966) (as amended by the Diseases of Animals (Amendment) Act, 2001 (No. 3 of 2001) and adapted by the Agriculture and Food (Alteration of Name of Department and Title of Minister) Order, 1999 ( S.I. No. 307 of 1999 )), hereby order as follows -

1.       This Order may be cited as the Diseases of Animals Act, 1966 (Foot-and-Mouth Disease) (Restriction on Movement of Persons) Order, 2001 and shall come into operation on 21 April, 2001.

2.       In this Order.

“animal” means an animal of the bovine, ovine, porcine, caprine or equine species, any other biungulate or poultry;

“agriculture-related place or premises” means a wholesale meat market, a mart or other premises where animals are displayed whether for sale or otherwise, an artificial insemination station, an abattoir or slaughterhouse, a building or land on which animals were or are present or have or had access including any land where animals are kept for farming purposes or any place or land used in relation to a place or premises aforesaid;

3.       The United Kingdom and the Netherlands are declared to be places infected with foot-and-mouth disease and the State is declared to be an area at risk of being infected with foot-and-mouth disease.

4.(1)   Subject to Article 5 of this Order, this Order applies to a person who enters the State and who, within a period of twenty-one days prior to such entry has been on an agriculture-related place or premises located in either the United Kingdom or the Netherlands, and shall continue to apply to that person for a period of twenty-one days commencing on the day after his or here arrival in the State.

(2)     A person to whom paragraph (1) of this Article applies shall not enter onto any land or premises within the State where animals are kept for farming purposes.

(3)     A person shall not cause or permit a person to whom paragraph (1) of this Article applies to enter onto any land or premises within the State where animals are kept for farming purposes.

(4)      Nothing in this Order shall prohibit a person, being the owner or person in charge of a place where animals are kept for farming purposes that is in one unit and lies partly within the State and partly in Northern Ireland and that is split in two parts by the land frontier with Northern Ireland, from engaging in activities related to animal husbandry in that place whether within the State or otherwise.

(5)    Paragraph (2) of this Article shall not apply to an inspector of the Minister who has been engaged in the eradication or control of disease in the United Kingdom or the Netherlands provided he or she is disinfected in such manner, and complies with such other requirements, as the Minister may, from time to time, direct prior to entry onto any land or premises within the State where animals are kept for farming purposes.

5.(1)   Notwithstanding paragraph (3) of Article 4 of this Order, the Minister may by licence authorise a person who, at any time within twenty-one days prior to the coming into operation of this Order, was on an agriculture-related place or premises in the United Kingdom or the Netherlands to enter onto land or premises within the State where animals are kept for farming purposes.

(2)    The Minister may grant a licence under this Article and attach conditions thereto or refuse an application.

Explanatory Note

(This note is not part of the instrument and does not purport to be a legal interpretation)

The effect of this Order is to prevent a person entering the State who, in the previous 21 days, has been in an agriculture related place or premises (as defined in Article 2) in either the United Kingdom or the Netherlands from entering onto such a place or premises and other places relating to processing of food of animal origin (as defined in Article 4(2)) for 21 days after arrival.
