S.I. No. 397/2001 - Waste Management (Licensing) (Amendment) Regulations, 2001
The Minister for the Environment and Local Government, in exercise of the powers conferred on him by sections 7 , 18 , 39 , 40 , 41 , 42 , 44 , 45 and 50 of the Waste Management Act, 1996 (No. 10 of 1996), hereby makes the following Regulations: - | ||||||||
1. These Regulations may be cited as the Waste Management (Licensing) (Amendment) Regulations, 2001. | ||||||||
2. The Waste Management (Licensing) Regulations, 2000 are hereby amended by the substitution of the following sub-article for sub-article 23(1): | ||||||||
“(1) An application (other than an application in respect of a waste recovery or disposal activity carried on after the date prescribed for the purposes of section 39(1) of the Act in relation to the said activity) or a submission may be withdrawn at any time before the making of the decision of the Agency on the application.”. | ||||||||

These Regulations amend Article 23(1) of the Waste Management (Licensing) Regulations, 2000 ( S.I. No. 185 of 2000 ). | ||||||||
They provide that an application for the grant or review of a waste licence may be withdrawn only where the said application concerns a proposed waste activity. |
