S.I. No. 614/2001 - Social Welfare (Consolidated Payments Provisions) (Amendment) (No. 7) (Euro) Regulations, 2001


The Minister for Social, Community and Family Affairs, in exercise of the powers conferred on him by sections 4 (as amended by section 9 of the Social Welfare Act, 2001 (No. 5 of 2001)), 36(1) (as amended by section 17 of the Social Welfare 1997 (No. 10 of 1997)), 84(8A) (inserted by section 27 of the Social Welfare Act, 2001 ), 84(13), 84(15) (as amended by section 37 of the Social Welfare Act, 2001 ), 89(7), 121(5) (both as amended by section 37 of the Social Welfare Act, 2001 ), 158(5), 199(2) (as amended by section 37 of the Social Welfare Act, 2001 ), 206A (inserted by section 11 of the Social Welfare Act, 1998 (No.6 of 1998)) and 209(5) of the Social Welfare (Consolidation) Act, 1993 (No. 27 of 1993) , hereby makes the following Regulations:-

Citation and construction.

1. (1) These Regulations may be cited as the Social Welfare (Consolidated Payments Provisions) (Amendment) (No. 7) (Euro) Regulations, 2001.

(2) These Regulations and the Social Welfare (Consolidated Payments Provisions) Regulations 1994 to 2001 shall be construed together as one and may be cited as the Social Welfare (Consolidated Payments Provisions) Regulations, 1994 to 2001.

Definitions.

2. In these Regulations “the Principal Regulations” means the Social Welfare (Consolidated Payments Provisions) Regulations, 1994 ( S.I. No. 417 of 1994 ).

Commencement.

3. These Regulations come into operation -

(a)    in so far as they relate to unemployment assistance, pre-retirement allowance and farm assist, on 26 December 2001,

(b)    in so far as they relate to unemployment benefit, on 27 December 2001,

(c)    in so far as they relate to disability benefit, maternity benefit, health and safety benefit, adoptive benefit, injury benefit, disablement gratuity and supplementary welfare allowance, on 31 December 2001,

(d)    in so far as they relate to disability allowance, on 2 January 2002,

(e)    in so far as they relate to carer's benefit, retirement pension, invalidity pension, one-parent family payment (other than where payable in respect of a widow or widower), carer's allowance, family income supplement and a relevant payment by virtue of section 18 (1)(a), (b) or (c) of the Social Welfare Act, 1996 (No. 7 of 1996), on 3 January 2002, and

(f)    in so far as they relate to disablement pension, death benefit under section 60, 61 or 62 of the Principal Act, old age (contributory) pension, widow's and widower's (contributory) pension, orphan's (contributory) allowance, bereavement grant, old age (non-contributory) pension, blind pension, widow's and widower's (non-contributory) pension, orphan's (non-contributory) pension and one-parent family payment payable in respect of a widow or widower, on 4 January 2002.

Amendments consequential on the introduction of the euro.

4. Each provision of the Principal Regulations mentioned in column (1) of the Schedule to these Regulations is amended by the substitution for the amount specified in column (2) of that Schedule opposite the mention of the provision in that column (1) (whether the amount occurs once or more than once in that provision), of the amount specified in column (3) of that Schedule, opposite the mention of the amount specified in that column 2.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

These Regulations provide for the conversion of certain monetary amounts contained in the the Social Welfare (Consolidated Payments Provisions) Regulations, 1994 to convenient Euro amounts. This is in line with the introduction of the new Euro currency effective from the first week in January 2002.
