S.I. No. 43/2002 - Company Law Enforcement Act 2001 (Commencement) (No. 4) Order 2002

I, Mary Harney, Minister for Enterprise, Trade and Employment, in exercise of the powers conferred on me by section 2 of the Company Law Enforcement Act 2001 (No. 28 of 2001 hereby order as follows:

1.         This Order may be cited as the Company Law Enforcement Act 2001 (Commencement) (No. 4) Order 2002.

2.   On 1^st March 2002 the following provisions of the Company Law Enforcement Act 2001 (No. 28 of 2001) shall come into operation —

(a)        paragraphs (a) and (c) of section 25 , insofar as those paragraphs relate to investigations under section 8 of the Companies Act 1990 (No. 33 of 1990 initiated on or after that date, and

(b)       section 107.

This order provides that paragraphs (a) and (c) of section 25 of the Company Law Enforcement Act 2001 shall come into operation on 1 March 2002. It provides that the provisions of these subsections shall only relate to section 8 investigations initiated on or after 1 March 2002.

The order also appoints 1 March 2002 as the date when section 107 of the Company Law Enforcement Act comes into operation.
