S.I. No. 496/2002 - European Communities (Milk Quota) (Teagasc) Regulations 2002

I, JOE WALSH, Minister for Agriculture and Food, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving further effect to Council Regulation (EEC) No. 3950/92 of 28 December 1992¹ and Commission Regulation (EEC) No. 536/93 of 9 March 1993² make the following regulations:

1.        These Regulations may be cited as the European Communities (Milk Quota (Teagasc) Regulations 2002.

2.        In these Regulations—

“partnership provisions” means Regulation 8 of, and the Twentieth, Twenty-first and Twenty-second Schedules to, the European Communities (Milk Quota) Regulations 2000 ( S.I. No. 94 of 2000 ) (inserted by Regulation 3(b) of the European Communities (Milk Quota) (Amendment) Regulations 2002 ( S.I. No. 97 of 2002 ));

“Teagasc” means Teagasc — The Agriculture and Food Development Authority

3.        The partnership provisions are amended—

(a)        in paragraph (1)(a) of Regulation 8—

(i)         by deleting the definition of “Board”, and

(ii)        by inserting the following after the definition of “partner”:

“‘Teagasc’ means Teagasc — The Agriculture and Food Development Authority.”,

(b)        in Regulation 8, by substituting “Teagasc” for “the Board” or “The Board” in each place where it occurs, and

(c)        in the Twentieth and Twenty-second Schedules, by substituting “Teagasc — The Agriculture and Food Development Authority” for “The Farm Apprenticeship Board” in each place where it occurs.

4.        (1)      Anything—

(a)        commenced by or on behalf of the Farm Apprenticeship Board, or

(b)        given by a person to the Farm Apprenticeship Board,

for the purposes of the partnership provisions but not fully dealt with by the Farm Apprenticeship Board before the making of these Regulations may be dealt with by Teagasc in accordance with those provisions.

 (2)      (a)        Nothing in this Regulation affects the validity of any act that was done before the making of these Regulations by the Farm Apprenticeship Board.

(b)        Every act done by or on behalf of the Farm Apprenticeship Board for the purposes of the partnership provisions shall, if and in so far as it was operative immediately before the making of these Regulations, have effect on and after the making of these Regulations as if it had been done by or on behalf of Teagasc.

These Regulations, which amend the European Communities (Milk Quota) Regulations, 2000 ( S.I. No 94 of 2000 ) as amended, transfer functions in respect of Milk Production Partnerships from the Farm Apprenticeship Board to Teagasc.
