S.I. No. 193/2003 - Diseases of Animals Act 1966 (Import of Cats and Dogs) (Control on Tapeworm (Echinococcus Multilocularis) and Ticks) Order 2003


I, Joe Walsh, Minister for Agriculture and Food, in exercise of the powers conferred on me by sections 3 , 11 , 13 and 33 of the Diseases of Animals Act 1966 (No. 6 of 1966) (as adapted by the Agriculture, Food and Rural Development (Alteration of Name of Department and Title of Minister) Order 2002 ( S.I. No. 306 of 2002 )) hereby Order as follows —

1.   This Order may be cited as the Diseases of Animals Act 1966 (Import of Cats and Dogs) (Control on Tapeworm (Echinococcus Multilocularis) and Ticks Order 2003.

2.(1)  In this Order —

“authorised officer” means an authorised officer under section 17A (inserted by the Diseases of Animals (Amendment) Act 2001 (No. 3 of 2001) of the Diseases of Animals Act 1966 ;

“cat” means a domestic cat (Felis cattus);

“certificate” means a certificate that has been prepared and completed in accordance with Article 4 by a person who is lawfully entitled to practice as a veterinary surgeon at the place of treatment of a cat or dog;

“dog” means a domestic dog (Canis familiaris);

“veterinary medicine” means an animal remedy within the meaning of the Animal Remedies Act 1993 (No. 23 of 1993).

(2) In this Order, a reference to an Article is to an Article of this Order.

3.   This Order does not apply to a cat or dog being brought directly into the State from a place in the United Kingdom, Channel Islands or Isle of Man.

4.   A person shall not bring a cat or dog into the State or cause or permit another person to bring a cat or dog into the State unless —

(a)  the cat or dog bears a unique identification either by means of an electronic identification system referred to in this Order as a transponder or by means of a clearly visible, indelible and legible tattoo,

(b)  not earlier than 48 and not later than 24 hours before embarkation on an air or sea vessel, the cat or dog has been treated by a veterinary surgeon lawfully entitled to practice at the place of treatment with veterinary medicines that act against

(i)          tapeworm (Echinococcus multilocularis) and contains praziquantal as the active ingredient; and

(ii)         ticks excluding a collar impregnated with acaricide, and

(c)  the cat or dog is accompanied by a certificate in the format set down in the attached Schedule or in a format acceptable to the Minister, signed by the veterinary surgeon who administered the treatment, stating —

(i)         the unique identification of the animal treated

(ii)        the date, place and time of the treatment, and

(iii)       the treatment, including the dosage and active ingredient used.

5.   A person shall, on request, produce a certificate for inspection by an authorised officer.

6.   Where the transponder referred to at Article 4(a) does not comply with ISO Standard 11784 or Annex A to ISO Standard 11785, the person accompanying the cat or dog must provide the means necessary for reading the transponder at the time of inspection.

7.   The master or person in charge of a vessel, vehicle or aircraft shall not bring a cat or dog into the State or cause or permit another person to bring a cat or dog into the State, unless it is accompanied by a certificate issued under Article 4(c).
