S.I. No. 273/2003 - Garda Síochána (Retirement) Regulations 2003


I, Michael McDowell, Minister for Justice, Equality and Law Reform, in exercise of the powers conferred on me by section 14 of the Police Forces Amalgamation Act 1925 (No. 7 of 1925 hereby, with the approval of Government, make the following regulations:

1.        These Regulations may be cited as the Garda Síochána (Retirement) Regulations 2003.

2.        The Interpretation Act 1937 (No. 38 of 1937) applies to these Regulations.

3.        Notwithstanding anything contained in —

(a)        the Garda Síochána (Retirement) Regulations 1934 (S.R. & O. No. 146 of 1934 ),

(b)        the Garda Síochána (Retirement) (No. 2) Regulations 1951 ( S.I. No. 335 of 1951 ),

(c)        the Garda Síochána (Retirement) Regulations 1990 ( S.I. No. 318 of 1990 ), or

(d)        the Garda Síochána (Retirement) Regulations 1996 ( S.I. No. 16 of 1996 ),

a member of the Garda Síochána who, immediately before the making of these Regulations, holds the rank of Deputy Commissioner and who, on or after their making, is appointed to the rank of Commissioner, shall retire upon attaining the age of 65 years.
