S.I. No. 387/2003 - The Irish Aviation Authority (Eurocontrol Safety Regulatory Requirements)Order 2003
The Irish Aviation Authority, in pursuance of sections 5 , 58 , 59 , 60 (k) and 65 (1) (a) (ii of the Irish Aviation Authority Act, 1993 , as amended by the Air Navigation and Transport (Amendment) Act, 1998 (No. 24 of 1998) and the Aviation Regulation Act 2001 (No. 1 of 2001), hereby orders — 1. This Order may be cited as The Irish Aviation Authority (Eurocontrol Safety Regulation Requirements) Order, 2003 2. This Order shall become effective on 1 September 2003 or on the date of its publication in the Irish Oifigiúil, whichever date occurs later. | ||||||
Definitions: | ||||||
3. “The Act” means the Irish Aviation Authority Act, 1993 , as amended; | ||||||
“Eurocontrol” : has the meaning ascribed to it in the Act | ||||||
“The Convention” has the meaning ascribed to it in the Act; | ||||||
“Eurocontrol Safety Regulatory Requirement (abbrev. ESARR)” means a safety requirement relating to air navigation services in the State and in airspace within the jurisdiction of the State specified by Eurocontrol and complementary to ICAO Standards and Recommended Practices as defined in the Annexes to the Chicago Convention | ||||||
Eurocontrol Safety Regulatory Requirements | 3. A Eurocontrol Safety Regulatory Requirement (ESARR) adopted by the Permanent Commission of Eurocontrol shall be effective, in whole or part, in relation to the provision of air navigation services in the State and the organizations and personnel employed therein as specified in a direction under this Order. | |||||
Directions | 4. Directions and advisory information under this Order may be given in the form of notices sent by letter or registered post to the persons or organization concerned or may be promulgated by Aeronautical information Circular or posted on the website of the Irish Aviation Authority | |||||

This Order provides a basis for the implementation in Irish Legislation of the Eurocontrol Safety and Regulatory Requirements produced by the Eurocontrol Safety Regulation Commission and adopted by the Eurocontrol Permanent Commission. This is a supplementary measure to implementation of the provisions of Annexes to the Convention in the schedule to the Act. This Order empowers the implementation of Eurocontrol Safety Regulatory Requirements in the State by an appropriate direction made by the Authority. |
