S.I. No. 400/2003 - Inland Post Amendment (No. 69) Scheme, 2003

An Post, in exercise of the powers conferred on it by Section 70 of the Postal and Telecommunications Services Act 1983 (No. 24 of 1983) as amended by Regulation 8 (4) of the European Communities (Postal Services) Regulations 2002 ( S.I. No. 616 of 2002 ), and with the concurrence of the Commission for Communications Regulation to the increases in charges herein made, hereby makes the following Scheme:

1. This Scheme may be cited as the Inland Post Amendment (No. 69) Scheme 2003.

2. This Scheme shall be operative with effect from the 30^th day of August 2003.

3. In this Scheme, “the Principal Warrant” means the Inland Post Warrant 1939 ( S.I. No. 202 of 1939 ) as amended;

“Scheme No. 60” means the Inland Post Amendment (No. 60) Scheme 1999 ( S.I. No. 61 of 1999 );

“Scheme No. 63” means the Inland Post Amendment (No. 63) Scheme 2002 ( S.I. No. 632 of 2002 );

“Scheme No. 68” means the Inland Post Amendment (No. 68) Scheme 2002 ( S.I. No. 649 of 2002 ).

4. All rates and charges payable upon letters and postal packets in this Scheme pertain to postal packets within the “reserved area” as defined by the European Communities (Postal Services) Regulations 2002 ( S.I. No. 616 of 2002 ).

5. All discounts receivable upon letters and postal packets in this Scheme pertain to postal packets within the “reserved area” as defined by the European Communities (Postal Services) Regulations 2002 ( S.I. No. 616 of 2002 ).

6. Words defined in the Principal Warrant shall have the same meaning in this Scheme.

7. The First Schedule to the Principal Warrant is hereby amended by the substitution for the entries therein contained (inserted by Regulation 6 of Scheme No. 63) of the entries in the First Schedule to this Scheme.

8. Scheme No. 60 and Scheme No. 68 are hereby revoked.

9. Regulation 10 of this Scheme applies to postal packets in respect of which agreements are made with An Post in order to achieve cost savings for An Post and the sharing of those cost savings with senders.

10. There shall be charged and paid upon postal packets posted to which this Regulation applies the rates specified at (1) of the First Schedule to the Principal Warrant. Subject to the terms of the agreement agreed by the sender and An Post and this Scheme, a sender shall benefit from the discount per postal packet specified in the Second Schedule to this Scheme. Notwithstanding the provisions of Regulation 10 of the Principal Warrant all postal packets to which this Scheme applies shall bear a prepaid Ceadunas stamp or franking impression approved by An Post.

		*Where a letter falls within more than one of 1(1), 1(2) or 1(3) above, the category giving the lowest rate of postage shall prevail.
2. Postcard	0.48 per item	Minimum dimensions: 90mm × 140mm, with a tolerance of 2mm. Maximum dimensions: Length, 235mm, width, 162mm, depth, 5 mm, with a tolerance of 2mm.	25g	A postcard upon which no part, or a part only, of the postage payable thereon is prepaid shall be forwarded charged with the amount of the deficient postage plus a handling fee of 63c.

2. A “Flat” is a postal packet with the following dimensions:

Minimum dimensions:

160mm x 250mm x 0.75mm.

Maximum dimensions:

250 mm × 350 mm × 18mm.

3. An “An Post Office of Acceptance” means the An Post Delivery Office Dublin 2 and the An Post branch office, designated for the purposes of this Scheme by An Post, in the following locations (and any other location as may from time to time be identified by An Post):

Bray, Castlebar, Cavan, Clonmel, Drogheda, Dundalk, Ennis, Galway Kilkenny, Letterkenny, Limerick, Longford, Naas, Navan, Roscommon, Sligo Tralee, Waterford and Wexford.

4. “Auto-sort” means sortation by An Post's automated sorting equipment.

5. “Deferred Processing” means sortation at least one business day after the postal packet enters the public postal network.

4. An “An Post Office of Acceptance” means the An Post Delivery Office Dublin 2 and the An Post branch office, designated for the purposes of this Scheme by An Post, in the following locations (and any other location as may from time to time be identified by An Post):

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

This Scheme applies to the Inland Post Service and shall be operative from the 30^th day of August, 2003. It authorises increases in the rates of postage and fees charged for postage of items in the Inland Service for Mail within the reserved area as defined in the European Communities (Postal Services) Regulations 2002 ( S.I. No. 616 of 2002 ). It also provides a means whereby discounts can be provided to customers of An Post reflecting cost savings associated with processing mail in the reserved area as defined in the European Communities (Postal Services) Regulations 2002 ( S.I. No. 616 of 2002 ).
