S.I. No. 502/2003 - Housing (New House Grant Etc.) Regulations, 1990 (Amendment) Regulations, 2003

The Minister for the Environment, Heritage and Local Government, in exercise of the powers conferred on him by section 5 of the Housing Act, 1966 (No.21 of 1966), as amended by section 24 of the Housing (Miscellaneous Provisions Act, 1992 (No. 18 of 1992), and by section 4 of the Housing (Miscellaneous Provisions) Act, 1979 (No. 27 of 1979), as amended by section 25 of the Housing Act, 1988 (No. 28 of 1988), with the consent of the Minister for Finance, hereby makes the following Regulations:

1.       These Regulations may be cited as the Housing (New House Grant etc.) Regulations, 1990 (Amendment) Regulations, 2003.

2.       The following sub article is hereby substituted for article 4 (2) (c) of the Housing (New House Grant etc.) Regulations, 1990 ( S.I. No. 34 of 1990 ).

“(2)(c)  In all cases covered by (a) and (b) above a new house the subject of a grant application, must be completed and occupied and an application for payment of a grant received by the Minister for the Environment, Heritage and Local Government on or before 5.30pm, 2 April 2004”.

3.       The following sub article (d) is hereby added to article 4 (2) of the Housing (New House Grant etc.) Regulations, 1990 ( S.I. No. 34 of 1990 ).

“(2)(d)  The Department will seek appropriate evidence of occupation on or before 2 April 2004, from inhabitants.”.

The Minister for Finance hereby consents to the foregoing Regulations.

These regulations provide for the extension of the deadline for the completion and occupation of houses where a new house grant application was received on or before 4 December 2002.
