S.I. No. 102/2004 - Oireachtas (Allowances To Members) and Ministerial and Parliamentary Offices (Amendment) Act 1992 (Allowances) (Amendment) Regulations 2004
I, CHARLIE McCREEVY, Minister for Finance, in exercise of the powers conferred on me by section 3 (4) of the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act 1992 (No. 3 of 1992), hereby make the following regulations: 1. These Regulations may be cited as the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act 1992 (Allowances) (Amendment) Regulations 2004. 2. These Regulations are to be taken to have come into operation on 30 June 2003. 3. The Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act 1992 (Allowances) (No. 2) Regulations 1992 ( S.I. No. 397 of 1992 ), are amended by substituting the following Regulation for Regulation 7: | ||||||||
“7 (1) Where a member of Dáil Eireann, incurs expenses— | ||||||||
(a) in establishing and equipping accommodation for his or her secretarial assistant elsewhere than in Leinster House, the appropriate authority shall, following receipt of a claim under paragraph (3) of this Regulation, pay to that member a sum of not more than €8,888.17 in final settlement of the expenses, and | ||||||||
(b) in maintaining such accommodation otherwise than in Leinster House, the appropriate authority shall, following receipt of a claim under paragraph (3) of this Regulation, pay to that member a sum of not more than €8,888.17 per year. | ||||||||
(2) The sum referred to in paragraph (1)(b) of this Regulation shall be paid in tranches of €4,444.08 on 1 January and €4,444.09 on 1 July in each year. | ||||||||
(3) A claim by a member for payment of a sum under this Regulation shall, where a claim has been made under paragraph (3), be made to the appropriate authority and shall be made in such form and contain such particulars as the Minister may from time to time direct. | ||||||||
(4) In this Regulation ‘Leinster House’ includes any office premises provided by the State in the vicinity of Leinster House for use by members of Dáil Eireann.”. | ||||||||

These regulations amend the existing regulations which provide for the payment of constituency office allowances to Deputies who incur expenses in the provision of an office in their constituency. These amended regulations come into effect from 30 June 2003. |
