S.I. No. 407/2004 - Finance Act 2004 (Section 52) (Commencement) Order 2004

I, Charlie McCreevy, Minister for Finance, in exercise of the powers conferred on me by section 52 (2) of the Finance Act 2004 (No. 8 of 2004), hereby order as follows:

1.   This Order may be cited as the Finance Act 2004 (Section 52)(Commencement) Order 2004.

2.   The 30th day of June 2004 is appointed as the day on which section 52 of the Finance Act 2004 (No. 8 of 2004) comes into operation.

EXPLANATORY NOTE.

This order appoints the 30th day of June 2004 as the date for coming into operation of section 52 of the Finance Act 2004 .

As a consequence:

Section 6 of the Roads Act 1920 (as amended by section 131 of the Finance Act 1992 ) is amended by deleting the requirement to present, at the time of first licensing of a vehicle, a vehicle registration certificate or other evidence as the Ministers for Finance or Environment, Heritage and Local Government require as proof that a vehicle has been registered by the Revenue Commissioners.

This amendment arises because of the introduction of a combined registration/licensing certificate where an electronic transfer of registration data from Revenue to the licensing authority is evidence that a vehicle has been registered.
