S.I. No. 264/2010 - Financial Emergency Measures in the Public Interest (Reduction of Payments to Veterinary Practitioners) (Adjustment) Regulations 2010.


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 11th June, 2010.

The Minister for Agriculture, Fisheries and Food, in exercise of the powers conferred on him by section 10 of the Financial Emergency Measures in the Public Interest Act 2009 (No. 5 of 2009), having carried out a review under subsection (13) of section 9 of that Act in respect of payments, standing provided for by order under the said section 10 , to veterinary practitioners and considering it appropriate to adjust (pursuant to subsection (14) of the said section 9) the rates so provided, with the consent of the Minister for Finance hereby makes the following regulations:

1. (1) These Regulations may be cited as the Financial Emergency Measures in the Public Interest (Reduction of Payments to Veterinary Practitioners) (Adjustment) Regulations 2010.

(2) The Principal Regulations and these Regulation shall be read together as one and may be cited as the Financial Emergency Measures in the Public Interest (Reduction of Payments to Veterinary Practitioners) Regulations 2009 and 2010.

2. In these Regulations “Principal Regulations” means the Financial Emergency Measures in the Public Interest (Reduction of Payments to Veterinary Practitioners) Regulations 2009 ( S.I. No. 216 of 2009 ).

3. (1) In respect of each time services referred to in Regulation 4(1)(a) of the Principal Regulations is rendered on or after the date of the making of these Regulations, the hourly rate for those services so rendered by a veterinary practitioner to whom the Principal Regulations relate as provided for in Part 3 of the Schedule to the Principal Regulations is adjusted in accordance with the Table to this paragraph in lieu of the rate provided for in that Part.

(2) In respect of each time a service referred to in Regulation 4(1)(b) of the Principal Regulations is rendered on or after the date of the making of these Regulations, the remuneration rates payable pursuant to the said Regulation 4(1)(b) are adjusted in accordance with the Table to this paragraph in lieu of the rates provided for by Part 4 of the Schedule to the Principal Regulations.

(3) (a) The rates provided for by these Regulations also incorporate the transfer by agreement of all top up fees that were previously made in a separate lump sum payment to veterinary practitioners in lieu of an increase in fees.

(b) In subparagraph (a) “top up fee” means a separate fee previously paid in a lump sum, which represented 11.79 per cent of the rates payable.
