S.I. No. 364/2010 - Diseases of Animals Act 1966 (National Pig Identification and Tracing System) (Amendment) Order 2010.

I, BRENDAN SMITH, Minister for Agriculture Fisheries and Food, in exercise of the powers conferred on me by sections 3 and 13 of the Diseases of Animals Act 1966 (No. 6 of 1966) (as adapted by the Agriculture and Food (Alteration of Name of Department and Title of Minister) Order 2007 ( S.I. No. 705 of 2007 )), for the purpose of giving further effect to Council Directive 2008/71/EEC of 15 July 2008 1 , hereby order as follows: | ||
1. This Order may be cited as Diseases of Animals Act 1966 (National Pig Identification and Tracing System) (Amendment) Order 2010. | ||
2. The Diseases of Animals Act 1966 (National Pig Identification and Tracing System) Order 2002 ( S.I. No. 341 of 2002 ) is amended by— | ||
(a) in Article 2(1) after the definition of “Minister” insert “‘person’ includes keeper;” and | ||
(b) after Article 4 insert the following Article— | ||
“4A. (1) A person who has a pig in his or her possession or under his or her control on a holding shall keep and maintain for a period of at least three years, a written record containing— | ||
(a) the number of pigs present on the holding, and | ||
(b) the following details in relation to the pigs on his or her holding— | ||
(i) date and number of births, | ||
(ii) date and number of deaths, and | ||
(iii) date, and identification details of movements in and out together with their origin and destination, | ||
within seven days of these events. | ||
(2) A person who has a pig in his or her possession or under his or her control on a holding shall at least annually conduct a census on his or her holding on a date to be determined by the Minister. | ||
(3) The Minister may determine the format in which records required under this Article are kept.” | ||
3. The following are revoked— | ||
(1) the European Communities (Registration of Holdings and Identification of Animals) Regulations 1996 ( S.I. No. 1 of 1996 ), and | ||
(2) the European Communities (Registration of Holdings and Identification of Animals) (Amendment) Regulations 2002. | ||

This Order amends the Diseases of Animals Act 1966 (National Pig Identification and Tracing System) Order 2002 to include ‘keeper’ and to lay down obligations and responsibilities in relation to the keeping of records and provision of information. | ||
