I, BRENDAN SMITH, Minister for Agriculture, Fisheries and Food, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), for the purpose of giving full effect to Commission Decision 2010/734/EU of 30 November 20101 , hereby make the following regulations: | ||
1. These Regulations may be cited as the European Communities (Avian Influenza) (Precautionary Measures) (Amendment) Regulations 2011. | ||
2. The European Communities (Avian Influenza) (Precautionary Measures) Regulations 2008 ( S.I. No. 7 of 2008 ) are amended- | ||
(a) in Regulation 2(1) by substituting for— | ||
(i) the definition of “approved disinfectant” the following— | ||
“ ‘approved disinfectant’ means— | ||
(i) a biocidal product which has been notified, authorised or registered for placing on the market and use under the European Communities (Authorization, Placing on the Market, Use and Control of Biocidal Products) Regulations 2001 ( S.I. No. 625 of 2001 ), | ||
(ii) is used for the prevention and control of avian influenza, and | ||
(iii) is published by the Minister in a manner that he or she considers appropriate;”, and | ||
(ii) the definition of “Commission Decision” the following— | ||
“ ‘Commission Decision’ means Commission Decision 2005/734/EC of 19 October 20052 as amended by Commission Decision 2005/745/EC of 21 October 20053 , Commission Decision 2005/855/EC of 30 November 20054 , Commission Decision 2006/574/EC of 18 August 20065 , Commission Decision 2007/105/EC of 15 February 20076 , Commission Decision 2007/803/EC of 6 December 20077 and Commission Decision 2010/734/EU of 30 November 2010;”, and | ||
(b) in Regulation 3(2)(f) and 3(4)(d) by deleting “during bird hunting”. | ||

These Regulations gives effect to Commission Decision No. 2010/734/EU of 30 November 2010 concerning biosecurity animal health control measures relating to Avian Influenza. | ||
