I, PHIL HOGAN, Minister for the Environment, Community and Local Government, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving effect to Council Directive 2010/79/EU¹ on the limitation of emissions of volatile organic compounds and amending Directive 2004/42/EC² hereby make the following Regulations:

Citation.

1. These Regulations may be cited as the Limitation of Emissions of Volatile Organic Compounds due to the use of Organic Solvents in Certain Paints, Varnishes and Vehicle Refinishing Products (Amendment) Regulations 2012.

Amendment.

2. The Limitation of Emissions of Volatile Organic Compounds due to the use of Organic Solvents in Certain Paints, Varnishes and Vehicle Refinishing Products Regulations 2007 ( S.I. No. 199 of 2007 ) are amended by substituting for the Third Schedule the following:

“THIRD SCHEDULE

ANALYTICAL METHODS

Permitted method for products with VOC content below 15% by mass where reactive diluents are not present:

EXPLANATORY NOTE

These Regulations transpose Directive 2010/79/EU on the limitation of emissions of volatile organic compounds (VOCs). Directive 2010/79/EU amends Directive 2004/42/EC by inserting a new Annex III concerning analytical methods used to determine the VOC content of products specified in Annex I.
