S.I. No. 309/2012 - European Communities (Intra-Community Transfers of Defence Related Products) (Amendment) Regulations 2012.

Notice of the making of this Statutory Instrument was published in

I, RICHARD BRUTON, Minister for Jobs, Enterprise and Innovation, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving effect to Commission Directive 2012/10/EU of 22 March 20121 amending Directive 2009/43/EC of the European Parliament and of the Council as regards the list of defence-related products, hereby make the following regulations:

1. These Regulations may be cited as the European Communities (Intra-Community Transfers of Defence Related Products) (Amendment) Regulations 2012.

2. Regulation 2 of the European Communities (Intra-Community Transfers of Defence Related Products) Regulations 2011 ( S.I. No. 346 of 2011 ), as amended by the European Communities (Intra-Community Transfers of Defence Related Products) (Amendment) Regulations 2011 ( S.I. No. 535 of 2011 ), is amended, in paragraph (1), by substituting for the definition of “Directive” the following definition:

“ ‘Directive’ means Directive 2009/43/EC of the European Parliament and of the Council of 6 May 20092 simplifying terms and conditions of transfers of defence-related products within the Community (as amended by Commission Directive 2010/80/EU of 22 November 20103 amending Directive 2009/43/EC of the European Parliament and of the Council as regards the list of defence-related products and Commission Directive 2012/10/EU of 22 March 20121 amending Directive 2009/43/EC of the European Parliament and of the Council as regards the list of defence-related products);”.

EXPLANATORY NOTE

The purpose of these Regulations is to amend the definition of “Directive” to mean Directive 2009/43/EC of the European Parliament and of the Council of 6 May 20094 simplifying terms and conditions of transfers of defence-related products within the Community (as amended by Commission Directive 2010/80/EU of 22 November 2010 amending Directive 2009/43/EC of the European Parliament and of the Council as regards the list of defence-related products and Commission Directive 2012/10/EU of 22 March 2012 amending Directive 2009/43/EC of the European Parliament and of the Council as regards the list of defence-related products).
