I, SIMON COVENEY, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by section 14 of the Sea-Fisheries and Maritime Jurisdiction Act 2006 (No. 8 of 2006) and the Sea Fisheries, Foreshore and Dumping at Sea (Transfer of Departmental Administration and Ministerial Functions) Order 2007 ( S.I. No. 707 of 2007 ) (as adapted by the Agriculture, Fisheries and Food (Alteration of Name of Department and Title of Minister) Order 2011 ( S.I. No. 455 of 2011 )), for the purpose of giving full effect to Commission Implementing Regulation (EU) No 737/2012 of 14 August 20121 hereby make the following regulations: | ||
1. These Regulations may be cited as the Sea-Fisheries (Celtic Sea Technical Measures) Regulations 2012. | ||
2. (1) In these Regulations; | ||
“Celtic Sea Technical Measures Regulation” means Commission Implementing Regulation (EU) No 737/2012 of 14 August 2012; | ||
“Council Regulation” means Council Regulation (EC) No. 850/1998 of 30 March 19982 as amended by Council Regulation (EC) No. 308/1999 of 8 February 19993 , Council Regulation (EC) No. 1459/1999 of 24 June 19994 , Council Regulation (EC) No. 2723/1999 of 17 December 19995 , Council Regulation (EC) No. 812/2000 of 17 April 20006 , Council Regulation (EC) No. 1298/2000 of 8 June 20007 , Council Regulation (EC) No. 724/2001 of 4 April 20018 , Council Regulation (EC) No. 973/2001 of 14 May 20019 , Council Regulation (EC) No. 602/2004 of 22 March 200410 , Council Regulation (EC) No. 1568/2005 of 20 September 200511 , Council Regulation (EC) No. 2166/2005 of 20 December 200512 , Regulation (EU) No. 579/2011 of the European Parliament and of the Council of 8 June 201113 . | ||
(2) A word or expression that is used in the Celtic Sea Technical Measures Regulation or the Council Regulation and is also used in these Regulations, has, unless the context otherwise requires, the same meaning in these Regulations as it has in the Celtic Sea Technical Measures Regulation or the Council Regulation, as the case may be. | ||
3. The Sea Fisheries (Technical Conservation Measures) Regulations 2006 (S.I. 171 of 2006) are amended in Regulation 2(1) by substituting for the definition of “Council Regulation” the following-. | ||
“Council Regulation” means Council Regulation (EC) No. 850/1998 of 30 March 1998 as amended by Council Regulation (EC) No. 308/1999 of 8 February 1999, Council Regulation (EC) No. 1459/1999 of 24 June 1999, Council Regulation (EC) No. 2723/1999 of 17 December 1999, Council Regulation (EC) No. 812/2000 of 17 April 2000, Council Regulation (EC) No. 1298/2000 of 8 June 2000, Council Regulation (EC) No. 724/2001 of 4 April 2001, Council Regulation (EC) No. 973/2001 of 14 May 2001, Council Regulation (EC) No. 602/2004 of 22 March 2004, Council Regulation (EC) No. 1568/2005 of 20 September 2005, Council Regulation (EC) No. 2166/2005 of 20 December 2005, Regulation (EU) No. 579/2011 of the European Parliament and of the Council of 8 June 2011. | ||
4. The master of— | ||
(a) an Irish sea-fishing boat wherever it may be, or | ||
(b) a sea-fishing boat in the exclusive fishing limits of the State, | ||
shall comply with the requirements imposed by the Celtic Sea Technical Measures Regulation in respect of fishing vessels and masters of such vessels. | ||

These Regulations have the purpose of giving effect to the provisions of Commission Regulation (EU) No. 737/2012 of 14 August 2012 on measures for the protection of certain Stocks in the Celtic Sea. | ||
