Amendment of section 57 of Medical Practitioners Act 2007 | ||
38. Section 57 (amended by section 34 of the Act of 2013) of the Medical Practitioners Act 2007 is amended— | ||
(a) in subsection (1) — | ||
(i) by substituting “Subject to subsection (1A), a person” for “A person”, and | ||
(ii) by substituting the following for paragraph (fa): | ||
“(fa) a failure to comply with— | ||
(i) regulations made under section 13 (2) of the Health (Pricing and Supply of Medical Goods) Act 2013 , or | ||
(ii) a provision of the Health Identifiers Act 2014 applicable to the practitioner in his or her capacity (if any) as a health services provider within the meaning of section 2 of that Act.”, | ||
and | ||
(b) by inserting the following after subsection (1): | ||
“(1A) A complaint shall not be made by a person other than the Minister if the ground concerned is a registered medical practitioner’s failure to comply with a provision referred to in subsection (1) (fa) (ii).”. |
