S.I. No. 13/2016 - Fines (Payment and Recovery) Act 2014 (Section 6) Regulations 2016.

I, FRANCES FITZGERALD, Minister for Justice and Equality, in exercise of the powers conferred on me by sections 3 and 6 of the Fines (Payment and Recovery) Act 2014 (No. 7 of 2014), hereby make the following regulations:

1. These Regulations may be cited as the Fines (Payment and Recovery) Act 2014 (Section 6) Regulations 2016.

2. In these Regulations, “Act” means the Fines (Payment and Recovery) Act 2014 (No. 7 of 2014).

3. Where a fined person opts to effect the payment of a fine by the payment of instalments under section 6(1)(a)(ii) of the Act such payment shall be effected in 13 instalments payable in accordance with Regulation 4.

4. (a) The first instalment shall be 10% of the amount of the fine, payable, in accordance with section 6(2) of the Act, 42 days from the date on which the fine was imposed.

(b) The 11 instalments subsequent to the first instalment shall each be 7.5% of the amount of the fine and—

(i) the second instalment shall be paid prior to the expiration of the period of 72 days from the date on which the fine was imposed, and

(ii) the next 10 instalments shall be paid prior to the expiration of each subsequent 30 day period.

(c) The final instalment shall be 7.5% of the amount of the fine and shall be paid prior to the expiration of 35 days from the date of payment of the 12th instalment.

5. The following persons are prescribed for the purposes of section 6(1)(c) of the Act as a person to whom the payment of a fine may be made:

(a) if the payment of the fine is to be effected by instalments in accordance with Regulation 4, An Post, or

(b) if the payment of the fine is to be effected by a single payment in accordance with section 6(1)(a)(i) of the Act, An Post or the Courts Service,

6. For the purposes of section 6(1)(b) of the Act, the following are prescribed as the means for paying a fine through An Post—

(a) cash,

(b) cheque,

(c) bank draft,

(d) postal money order,

(e) credit card, or

(f) debit card,

and such payment may be made in a post office, by telephone, by post or on the internet.

7. For the purposes of section 6(1)(b) of the Act, the following are prescribed as the means for paying a fine through the Courts Service—

(a) cash,

(b) cheque,

(c) bank draft,

(d) postal money order.
