S.I. No. 137/2016 - Razor Clam (Conservation of Stocks) (Inishkea Islands) Regulations 2016.

I, SIMON COVENEY, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by sections 3 and 15 of the Sea-Fisheries and Maritime Jurisdiction Act 2006 (No. 8 of 2006) and the Sea Fisheries, Foreshore and Dumping at Sea (Transfer of Departmental Administration and Ministerial Functions) Order 2007 ( S.I. No. 707 of 2007 ) (as adapted by the Agriculture, Fisheries and Food (Alteration of Name of Department and Title of Minister) Order 2011 ( S.I. No. 455 of 2011 )), hereby make the following regulations:

1. These Regulations may be cited as the Razor Clam (Conservation of Stocks) (Inishkea Islands) Regulations 2016.

2. In these Regulations—

“razor clams” means Ensis spp.;

“specified zone” means the area enclosed by an imaginary line drawn from:

Latitude 54°07.7880’N, Longitude 010°10.6954’W through

Latitude 54°07.9160’N, Longitude 010°09.8270’W through

Latitude 54°05.1760’N, Longitude 010°12.0900’W through

Latitude 54°05.7557’N, Longitude 010°13.9481’W through

Latitude 54°06.2120’N, Longitude 010°13.9957’W and along the High Water Mark to

Latitude 54°07.4035’N, Longitude 010°12.3072’W through

Latitude 54°07.4797’N, Longitude 010°12.1495’W and along the High Water Mark to

Latitude 54°07.7880’N, Longitude 010°10.6954’W.

3. (1) The master or person in charge of a sea-fishing boat shall not fish for or attempt to fish for razor clams in the specified zone.

(2) The master or person in charge of a sea-fishing boat shall not cause or permit any person on board the boat to fish for or attempt to fish for razor clams in the specified zone.

4. (1) The master or person in charge of a sea-fishing boat shall not have or retain on board or land razor clams taken or caught in the specified zone.

(2) The master or person in charge of a sea-fishing boat shall not cause or permit any person on board the boat to have or retain on board or land razor clams taken or caught in the specified zone.

5. A person shall not have in his or her possession or under his or her control and shall not buy, handle, weigh, tranship, transport, process, store, or sell any razor clams taken or caught in the specified zone after the making of these Regulations.
