S.I. No. 326/2016 - Social Protection (Delegation of Ministerial Functions) Order 2016.

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 24th June, 2016.

The Government, on the request of the Minister for Social Protection and in exercise of the powers conferred on them by section 2 (1) of the Ministers and Secretaries (Amendment) (No. 2) Act 1977 (No. 28 of 1977), hereby order as follows:

1. This Order may be cited as the Social Protection (Delegation of Ministerial Functions) Order 2016.

2. The powers (other than the power to prosecute an offence) and duties of the Minister for Social Protection conferred on him—

(a) by or under the provisions of the enactment specified in Part 1 of the Schedule, and

(b) under the provisions of the Regulations specified in Part 2 of the Schedule,

are delegated to Finian McGrath, Minister of State at the Department of Social Protection.

SCHEDULE

PART 1

Chapters 8A and 17 of Part 2 and Chapters 5, 8A and 10 of Part 3 of the Social Welfare Consolidation Act 2005 (No. 26 of 2005)

Section 4 of Part 1 and Part 9 of the Social Welfare Consolidation Act 2005 , in so far as they relate to Chapters 8A and 17 of Part 2 and Chapters 5, 8A and 10 of Part 3 of that Act

PART 2

Chapters 1A and 9 of Part 2 and Chapters 5 and 5A of Part 3 of the Social Welfare (Consolidated Claims, Payments and Control) Regulations 2007 to 2015

Part 1, Chapter 6 of Part 3 and Parts 7, 8 and 9 of the Social Welfare (Consolidated Claims, Payments and Control) Regulations 2007 to 2015, in so far as they relate to Chapters 1A and 9 of Part 2 and Chapters 5 and 5A of Part 3 of those Regulations

Part 1, Chapter 6 of Part 3 and Parts 7, 8 and 9 of the Social Welfare (Consolidated Claims, Payments and Control) Regulations 2007 to 2015, in so far as they relate to Chapter 5 of Part 3 of the Social Welfare Consolidation Act 2005 .

The Social Protection (Delegation of Ministerial Functions) Order 2016 delegates to Finian McGrath T.D., Minister of State at the Department of Social Protection, the statutory powers and duties of the Minister for Social Protection mentioned in the Order. These are in respect of the following social welfare schemes; Partial Capacity Benefit, Invalidity Pension, Blind Pension, Domiciliary Care Allowance and Disability Allowance.
