S.I. No. 433/2018 - Road Traffic (Courses of Instruction) (Motorcycles) (Amendment) Regulations 2018

I, SHANE ROSS, Minister for Transport, Tourism and Sport, in exercise of the powers conferred on me by section 42 (2) of the Road Traffic Act 1961 (No. 24 of 1961) and section 18 of the Road Traffic Act 1968 (No. 25 of 1968) and the National Roads and Road Traffic (Transfer of Departmental Administration and Ministerial Functions) Order 2002 ( S.I. No. 298 of 2002 ) (as adapted by the Transport (Alteration of Name of Department and Title of Minister) Order 2011 ( S.I. No. 141 of 2011 )), hereby make the following regulations:

1. (1) These Regulations may be cited as the Road Traffic (Courses of Instruction) (Motorcycles) (Amendment) Regulations 2018.

(2) These Regulations come into operation on 5 November 2018.

2. The Road Traffic (Courses of Instruction) (Motorcycles) Regulations 2011 ( S.I. No. 681 of 2011 ) are amended—

(a) in Regulation 2(1)—

(i) by the insertion of the following definitions:

“ ‘code 46’ has the meaning assigned to it by Regulation 32 of the Driver Licensing Regulations;

‘light quadricycle’ has the meaning assigned to it by Article 1(3)(a) of Directive 2002/24/EC of the European Parliament and of the Council of 18 March 20021 ;

‘trainee’ means a person undergoing an IBT course;”, and

(ii) by the substitution of the following definition for the definition of “relevant category”:

“ ‘relevant category’ means any of the following categories of vehicle:

(a) A,

(b) A2,

(c) A1,

(d) AM;”,

(b) in Regulation 3—

(i) by the insertion of the following paragraph after paragraph (a):

“(aa) A2”,

(ii) in paragraph (c) by the substitution of “AM” for “M”, and

(iii) by the deletion of paragraph (d),

(c) in Regulation 4—

(i) in paragraph (1)(b)(ii), by substituting “a valid IBT certificate” for “an IBT certificate”,

(ii) by substituting for paragraph (2)(b) the following:

“(b) holds a valid IBT certificate in respect of category A, A2, A1 or AM as appropriate and carries the certificate with him or her while so driving.”,

(iii) in paragraph (5)(a), by substituting “is in possession of a valid IBT certificate issued under” for “is issued with an IBT certificate under”,

(iv) by the substitution of the following Table for the Table to the Regulation:

(v) in paragraph (6) by substituting “a valid IBT certificate” for “an IBT certificate”,

(i) by the substitution of the following paragraph for paragraph (3):

“(3) An IBT course shall, in respect of each course specified in column (1) of the Table to this paragraph, consist of training in the procedures and processes for the modules set out in Schedule 1 and specified in column (2) opposite that course.

(e) in Regulation 6—

(i) by the deletion of paragraph (1),

“(2) A person who holds a driving licence and valid IBT certificate for the category of course specified in column (1) of the Table to this paragraph who is issued with a learner permit in a category specified in column (2) opposite that category of course shall be required to successfully complete initial basic training in the module set out in Schedule 1 and specified in column (3) opposite that category of course.

(iii) in paragraph (3)—

(I) by the substitution of “46” for “73”, and

(II) by the substitution of “a motor tricycle in category A” for “B tricycle”,

(iv) by the insertion of the following after paragraph (3):

“(4) A person who is undertaking an IBT course in respect of a light quadricycle in category AM shall not be required to walk alongside the vehicle while maintaining proper balance and control as part of module 1.”,

(f) in Regulation 7(b), by the insertion of “or 5” after “module 4”,

(g) in Regulation 12, by the insertion of the following paragraphs after paragraph (4):

“(5) A trainer, when recording in a logbook that a person has completed a module of training under these Regulations, shall notify the Authority of the completion of the module by the person and shall maintain a record of this notification.

(6) The notification under paragraph (5) shall be given to the Authority in an electronic form or such other form as may be determined by the Authority.”,

(h) by the substitution of the following Schedule for Schedule 1:

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

These Regulations amend the Regulations relating to Initial Basic Training to be taken by learner motorcyclists, including the content of courses, the format of certificates issued on completion of courses, and related matters.
