I, EAMON RYAN, Minister for Transport, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving effect to Regulation (EC) No. 1008/2008 of the European Parliament and of the Council of 24 September 2008, hereby make the following regulations1 : | ||
1 These Regulations may be cited as the European Communities (Common Rules for the Operation of Air Services in the Community) (Amendment) Regulations 2021. | ||
2. The European Communities (Common Rules for the Operation of Air Services in the Community) Regulations 2008 ( S.I.No.426 of 2008 ) are amended – | ||
(a) in Regulation 6 – | ||
(i) in paragraph (1), by the substitution of “Commission” for “Minister”, | ||
(ii) in paragraph (2), by the substitution of “Commission” for “Minister”, | ||
(b) in Regulation 7, by the substitution of “Commission” for “Minister”. | ||

These Regulations amend the European Communities (Common Rules for the Operation of Air Services in the Community) Regulations 2008 ( SI No. 426 of 2008 ). The purpose of these Regulations is to give further effect to the implementation of Regulation (EC) No. 1008/2008 on common rules for the operation of air services in the Community, in so far as to transfer the power to enforce Article 23 of Regulation (EC) No. 1008/2008 from the Minister for Transport to the Commission for Aviation Regulation. | ||
