I, STEPHEN DONNELLY, Minister for Health, in exercise of the powers conferred on me by subsection (3) of section 53C (inserted by section 12 of the Health (Amendment) Act 2013 (No. 31 of 2013)) of the Health Act 1970 (No. 1 of 1970), with the consent of the Minister for Public Expenditure and Reform, hereby make the following regulations: | ||
1. These Regulations may be cited as the Health (Acute In-Patient Charges) Regulations 2021. | ||
2. These Regulations shall come into operation on 10 May 2021. | ||
3. In these Regulations, “Act of 1970” means the Health Act 1970 (No. 1 of 1970). | ||
4. (1) The charge referred to in subsection (2) of section 53C of the Act of 1970 for acute in-patient services provided by or on behalf of the Health Service Executive shall be imposed on persons other than those specified in subsection (9) of section 53C of that Act. | ||
(2) The maximum number of days in respect of which the charge referred to in paragraph (1) may be imposed on a person in any period of 12 consecutive months shall be 10 days. | ||
The Minister for Public Expenditure and Reform consents to the foregoing Regulations. | ||

EXPLANATORY NOTE | ||
(This note is not part of the Instrument and does not purport to be a legal interpretation). | ||
These Regulations set out the persons liable for the acute in-patient daily charge provided for under section 53C(1) of the Health Act 1970 (as amended). | ||
It also provides that the maximum number of days this daily charge may be imposed over a period of twelve consecutive months shall be 10 days. |
