S.I. No. 534/2021 - District Court (Fees) (Amendment) (No. 2) Order 2021

I, HEATHER HUMPHREYS, Minister for Justice, in exercise of the powers conferred on me by section 65 (as amended by section 66 of the Civil Law (Miscellaneous Provisions) Act 2011 (No. 23 of 2011)) of the Courts of Justice Act 1936 (No. 48 of 1936) (as adapted by the Justice and Equality (Alteration of Name of Department and Title of Minister) Order 2020 ( S.I. No. 452 of 2020 )), with the consent of the Minister for Public Expenditure and Reform, hereby order as follows:

1. (1) This Order may be cited as the District Court (Fees) (Amendment) (No. 2) Order 2021.

(2) This Order comes into operation on 22 October 2021.

2. The District Court (Fees) Order 2014 ( S.I. No. 22 of 2014 ) (as amended by Article 2 of the District Court (Fees) (Amendment) Order 2021 ( S.I. No. 444 of 2021 )) is amended by the insertion of the following Article after Article 4B:

“4C. Notwithstanding Article 2, no fee shall be payable under this Order in respect of the item specified in column (1) of Part 4 of the Schedule, at reference number (7), where the application is for a Special Exemption Order that has effect at any time during the period beginning on 22 October 2021 and ending on 31 December 2021.”.

The Minister for Public Expenditure and Reform consents to the making of the foregoing Order.
