S.I. No. 437/2024 - Garda Síochána (Retirement) Regulations 2024

I, HELEN MCENTEE, Minister for Justice, in exercise of the powers conferred on me by section 122(1)(h) of the Garda Síochána Act 2005 (No. 20 of 2005) (as adapted by the Justice and Equality (Alteration of Name of Department and Title of Minister) Order 2020 ( S.I. No. 452 of 2020 )), after consulting with the Garda Commissioner and the Policing Authority and with the approval of the Government, hereby make the following regulations:

1. These Regulations may be cited as the Garda Síochána (Retirement) Regulations 2024.

2. These Regulations shall come into operation on 3 September 2024.

3. Subject to section 4 of the Public Service Superannuation (Miscellaneous Provisions) Act 2004 (No. 7 of 2004), and notwithstanding anything contained in –

(a) the Garda Síochána (Retirement) Regulations 1934 (S.R & O., No. 146 of 1934),

(b) the Garda Síochána (Retirement) (No. 2) Regulations 1951 ( S.I. No. 335 of 1951 ), or

(c) the Garda Síochána (Retirement) Regulations 1996 ( S.I. No. 16 of 1996 ),

a member of the Garda Síochána who was appointed as a new entrant to the Garda Síochána on or after 1 April 2004 and who holds a rank below the rank of Garda Commissioner shall retire on attaining the age of 62 years.

The Government hereby approve of the foregoing Regulations.
