S.I. No. 474/2024 - Public Health (Tobacco) Act 2002 (Fixed Payment Notice) Regulations 2024


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 24th September, 2024.

I, STEPHEN DONNELLY, Minister for Health, in exercise of the powers conferred on me by section 56 (inserted by section 49 of the Public Health (Tobacco Products and Nicotine Inhaling Products) Act 2023 (No. 35 of 2023)) of the Public Health (Tobacco) Act 2002 (No. 6 of 2002), hereby make the following regulations:

1. (1) These Regulations may be cited as the Public Health (Tobacco) Act 2002 (Fixed Payment Notice) Regulations 2024.

(2) These Regulations shall come into operation on the 23rd day of September 2024.

2. In these Regulations –

“Act of 2002” means the Public Health (Tobacco) Act 2002 (No. 6 of 2002);

“Act of 2023” means the Public Health (Tobacco Products and Nicotine Inhaling Products) Act 2023 (No. 35 of 2023).

3. The form set out in the Schedule is prescribed for the purposes of subsection (1) of section 56 of the Act of 2002 in relation to an offence alleged to have been committed under section 29 of the Act of 2023.

4. The amount of €2,000 is prescribed for the purposes of subsection (4) of section 56 of the Act of 2002 in relation to an offence alleged to have been committed under section 29 of the Act of 2023.

You are not obliged to make the payment specified in this Notice. However, you will be prosecuted for the alleged offence if you do not make payment as mentioned above.

These Regulations prescribe the form of a fixed payment notice under section 56 (inserted by section 49 of the Public Health (Tobacco Products and Nicotine Inhaling Products) Act 2023 (No. 35 of 2023)) of the Public Health (Tobacco) Act 2002 (No. 6 of 2002) and the fixed payment payable in respect of the offence under section 29 of the Act of 2023.

These Regulations may be cited as the Public Health (Tobacco) Act 2002 (Fixed Payment Notice) Regulations 2024 and come into operation on 23 September 2024.
