S.I. No. 529/2024 - European Union (Electronic Communications Code) (Amendment) Regulations 2024

I, EAMON RYAN, Minister for the Environment, Climate and Communications, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving further effect to Directive (EU) 2018/1972 of the European Parliament and of the Council of 11 December 2018 establishing the European Electronic Communications Code (Recast)1 hereby make the following regulations:

1. These Regulations may be cited as the European Union (Electronic Communications Code) (Amendment) Regulations 2024.

2. The European Union (Electronic Communications Code) Regulations 2022 ( S.I. No. 444 of 2022 ) are amended –

(a) in Regulation 2(1) by the insertion of the following definition after “Act of 2009”:

“‘Act of 2022’ means the Consumer Rights Act 2022 (No. 37 of 2022);”

(b) in Regulation 2(1) by the substitution of the definition of “durable medium” for the following:

‘durable medium’ has the same meaning as in section 2(1) of the Act of 2022;”

(c) in Regulation 87 by the substitution of the following for paragraph (1):

“(1) Before a consumer is bound by a contract or any corresponding offer, a provider of publicly available electronic communications services, other than transmission services used for the provision of machine-to-machine services, shall provide the consumer with the information referred to in section 101, 103 or 106 of the Act of 2022 as the case may be, and, in addition the information listed in Schedule 7, to the extent that the information relates to a service the provider provides.”

These Regulations amend the European Union (Electronic Communications Code) Regulations 2022 ( S.I. No. 444 of 2022 ) to replace references to the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013 ( S.I. No. 484 of 2013 ) with references to the Consumer Rights Act 2022.
