S.I. No. 605/2024 - Social Welfare (Consolidated Claims, Payments and Control) (Amendment) (No. 17) (Conditions for Receipt of Jobseeker’s Payments) Regulations 2024

I, HEATHER HUMPHREYS, Minister for Social Protection, in exercise of the powers conferred on me by sections 4 (amended by section 14 and reference 1 of the Schedule to the Social Welfare (Miscellaneous Provisions) Act 2024 (No. 24 of 2024)), 62(9) and 141(7) of the Social Welfare Consolidation Act 2005 (No. 26 of 2005).

Citation and construction

1. (1) These Regulations may be cited as the Social Welfare (Consolidated Claims, Payments and Control) (Amendment) (No. 17) (Conditions for Receipt of Jobseeker’s Payments) Regulations 2024.

(2) These Regulations and the Social Welfare (Consolidated Claims, Payments and Control) Regulations 2007 to 2024 shall be construed together as one and may be cited together as the Social Welfare (Consolidated Claims, Payments and Control) Regulations 2007 to 2024.

Commencement

2. These Regulations come into operation on 18 November 2024.

Conditions for receipt of jobseeker’s payments

3. The Social Welfare (Consolidated Claims, Payments and Control) Regulations 2007 ( S.I. No. 142 of 2007 ) are amended–

(a) in article 44 (amended by article 2 of Social Welfare (Consolidated Claims, Payments and Control) (Amendment) (No. 2) (Days not to be treated as days of unemployment) Regulations 2024 ( S.I. No. 35 of 2024 )) by the insertion of the following sub-article after sub-article (3):

“(4) For the purposes of Chapter 12 of Part 2, and notwithstanding any other provision in this article, where a person is entitled to jobseeker’s benefit in respect of any day in a payment week, and that person commences employment in that payment week, which results in their claim to jobseeker’s benefit being closed, any remaining days in that payment week where they would have been ordinarily entitled to jobseeker’s benefit but for the reason that they commenced employment, shall be considered to be a day of unemployment.”, and

(b) in article 117 (amended by article 6 of the Social Welfare (Consolidated Claims, Payments and Control) (Amendment) (No. 6) (Retained Fire Fighters) Regulations 2013 ( S.I. No. 254 of 2013 )) by the insertion of the following sub-article after sub-article (2):

“(3) For the purposes of Chapter 2 of Part 3, and notwithstanding any other provision in this article, where a person is entitled to jobseeker’s allowance in respect of any day in a payment week, and that person commences employment in that payment week, which results in their claim to jobseeker’s allowance being closed, any remaining days in that payment week where they would have been ordinarily entitled to jobseeker’s allowance but for the reason that they commenced employment, shall be considered to be a day of unemployment.”.

These Regulations provides that for the week a person returns to employment, that person will be entitled to the full payment of Jobseeker’s Benefit or of Jobseeker’s Allowance for that week.
