S.I. No. 665/2024 - European Union (Renewable Energy) Regulations 2024

I, EAMON RYAN, Minister for Transport, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving further effect to Articles 25 and 26 of Directive (EU) 2018/2001 of the European Parliament and of the Council of 11 December 20181 , hereby make the following regulations:

1. These Regulations may be cited as the European Union (Renewable Energy) Regulations 2024.

2. These Regulations shall come into operation on 1 January 2025.

3. The National Oil Reserves Agency Act 2007 (No. 7 of 2007) is amended by the substitution of the following section for section 44D:

Rate of renewable transport fuel obligation, advanced biofuel obligation, crop cap and high ILUC-risk biofuel

44D. The percentage rate that applies for the obligation period beginning on 1 January 2025 and ending on 31 December 2025 shall –

(a) in respect of the renewable transport fuel obligation, be 25 per cent,

(b) in respect of the advanced biofuel obligation, be 1.5 per cent,

(c) in respect of the crop cap, be 2.4 per cent, and

(d) in respect of the high ILUC-risk cap, be 75 per cent of the total certified disposal of biofuels and biogas produced from high ILUC-risk feedstock that were, during the period beginning on 1 January 2019 and ending on 31 December 2019, supplied by a renewable transport fuel obligation account holder.”.

EXPLANATORY NOTE

These regulations are made under Section 3 of the European Communities Act 1972 and come into effect on 1st January 2025. The purpose of these Regulations is to amend Part 5A of the National Oil Reserves Agency Act 2007 (No. 7 of 2007).

The amendment to section 44D of the principal Act sets the percentage rates that apply for the 2025 renewable transport fuel obligation period by establishing the renewable transport fuel obligation as being 25 per cent, the advanced biofuel obligation as being 1.5 per cent, the crop cap as being 2.4 per cent and the high ILUC-risk cap as being 75 per cent of the total certified disposal of biofuels and biogas produced from high ILUC-risk feedstock supplied during the 2019 obligation period by a renewable transport fuel account holder.
