S.I. No. 736/2024 - Public Health (Tobacco Products and Nicotine Inhaling Products) Act 2023 (Fees) Regulations 2024

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 3rd January, 2025.

I, STEPHEN DONNELLY, Minister for Health, in exercise of the powers conferred on me by sections 5 and 18 of the Public Health (Tobacco Products and Nicotine Inhaling Products) Act 2023 (No. 35 of 2023), hereby make the following regulations:

1. (1) These Regulations may be cited as the Public Health (Tobacco Products and Nicotine Inhaling Products) Act 2023 (Fees) Regulations 2024.

(2) These Regulations shall come into operation on the 2nd day of February 2026.

2. The amount of €1000 is prescribed as the fee payable to the Executive for the purposes of an application for a licence to sell tobacco products.

3. The amount of €800 is prescribed as the fee payable to the Executive for the purposes of an application for a licence to sell nicotine inhaling products.

4. The amount of €1800 is prescribed as the fee payable to the Executive for the purposes of an application for a licence to sell tobacco products and nicotine inhaling products.

5. The amount of €1000 is prescribed as the fee payable to the Executive for the purposes of an application for renewal of a licence to sell tobacco products.

6. The amount of €800 is prescribed as the fee payable to the Executive for the purposes of an application for renewal of a licence to sell nicotine inhaling products.

7. The amount of €1800 is prescribed as the fee payable to the Executive for the purposes of an application for renewal of a licence to sell tobacco products and nicotine inhaling products.

These Regulations set out the fees to be paid to the National Environmental Health Service of the Health Service Executive in respect of matters under Part 2 of the Public Health (Tobacco Products and Nicotine Inhaling Products) Act 2023 .
