S.I. No. 60/2025 - European Union (Training, Certification and Watchkeeping for Seafarers) (Amendment) Regulations 2025


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 7th March, 2025.

I, DARRAGH O’BRIEN, Minister for Transport, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), and for the purpose of giving further effect to Directive (EU) 2022/993 of the European Parliament and of the Council of 8 June 20221 , hereby make the following regulations:

1. These Regulations may be cited as the European Union (Training, Certification and Watchkeeping for Seafarers) (Amendment) Regulations 2025.

2. The European Union (Training, Certification and Watchkeeping for Seafarers) Regulations 2014 ( S.I. No. 242 of 2014 ), as amended by the European Union (Training, Certification and Watchkeeping for Seafarers) (Amendment) Regulations 2021 ( S.I. No. 454 of 2021 ), are amended –

(a) in Regulation 2(1), by substituting for the definition of “Directive” the following:

“‘Directive’ means Directive (EU) 2022/993 of the European Parliament and of the Council of 8 June 20221 ;

‘Directive of 2008’ means Directive 2008/106/EC of the European Parliament and of the Council of 19 November 20082 (as amended by Directive 2012/35/EU of the European Parliament and of the Council of 21 November 20123 , and Directive (EU) 2019/1159 of the European Parliament and of the Council of 20 June 20194 );”,

(b) in Regulation 2, by substituting paragraph (3) with the following:

“(3) In these Regulations a reference –

(a) to an Article is a reference to an Article of the Directive of 2008, which shall be construed as an Article of the Directive, in accordance with the correlation table in Annex V to the Directive,

(b) to an Annex is a reference to an Annex to the Directive of 2008, which shall be construed as an Annex to the Directive, in accordance with the correlation table in Annex V to the Directive,

(c) to a Chapter is a reference to a Chapter of Annex I, and

(d) to Part A is a reference to Part A of the code.”,

(c) by deleting Regulation 31, and

(d) in Schedule 3 –

(i) in the third entry, relating to Drogheda, in column (3) by substituting for:

“In winter:

No partially smooth waters”

the following:

“In winter:

In favourable weather only, within a radius of 1.3 nautical miles from the eastern tip of the north breakwater and terminating at the northern and southern foreshores respectively for vessels engaged in dredging operations only”, and

(ii) in the seventh entry, relating to Howth Sound, by substituting for the matter in column (3), the following:

“Within a line from the North end of Eastern Breakwater to Thulla and south of a line drawn westward from Steer Rock”.

EXPLANATORY NOTE

These Regulations amend the European Union (Training, Certification and Watchkeeping for Seafarers) Regulations 2014 ( S.I. No. 242 of 2014 ), as amended, in relation to:

(a) the references to Directive 2008/106/EC, as amended, which has been codified and repealed by Directive (EU) 2022/993,

(b) the transitional provisions, which are no longer relevant, and

(c) Schedule 3, as inserted by the European Union (Training, Certification and Watchkeeping for Seafarers) (Amendment) Regulations 2021 ( S.I. No. 454 of 2021 ), regarding the descriptions of the areas of partially smooth waters in Drogheda and Howth Sound, respectively.
